COUNCILMAN STIEGLER             offers the following and moves for its adoption:
WHEREAS, Town Clerk Rachael Rancourt has provided copies of the minutes of the October 15, 2014 Town Board Meeting to all members of the Beekman Town Board; and
WHEREAS, Town Board members have had the opportunity to review said minutes; now therefore be it
RESOLVED, the Town Board hereby adopts the minutes of the October 15, 2014 Town Board Meeting.

RESOLUTION NO. 11:05:14 – 2 (179)
RE: Set Public Hearing to Change User Rates for Dover Ridge Water and Sewer and Establish Late Fees 
COUNCILMAN BATTAGLINI           offers the following and moves for its adoption: 
WHEREAS, the Town Board of the Town of Beekman is responsible for the operation and management of the Dover Ridge Water and Sewer Districts; and WHEREAS, Article 14-F of the General Municipal Law authorizes the local legislative body to increase water and sewer user rates on behalf of the water and sewer districts by resolution after a public hearing; and WHEREAS, the Town Board is desirous in adjusting the water and sewer user rates to reflect the actual cost of operating the water and sewer districts as well as to impose penalties for late charges; and WHEREAS, the adopted 2015 budget is the basis of calculation of new user rates for Dover Ridge Water and Sewer Districts; now therefore be it RESOLVED, that a public hearing for increasing the water and sewer user rates and the imposition and collection of late charges be held on the 19th day of November, 2014 at 7:00 p.m. at Town Hall, 4 Main Street, Poughquag, in the Town of Beekman, New York, and that notice of the time and place of such hearing be posted and published once on or before the 7th day of November in the Poughkeepsie Journal, a newspaper circulating in the Town of Beekman, and that such notice shall be posted on the bulletin board in the Town Clerks Office and posted on the Town of Beekman Website.

RE: Appointment to Recreation Commission
SUPERVISOR ZULAUF             offers the following and moves for its adoption:
WHEREAS, the Town Board will make appointments to the various boards; and
WHEREAS, Joe Ellman has resigned, creating a vacancy with a term to expire 12/31/19; now therefore be it
RESOLVED, that the Town Board hereby makes the following appointments to be effective immediately:
Recreation Commission - Joseph Deserre term to expire 12/31/19; and be it further
RESOLVED, that all appointments are contingent upon completion and submissions of the new Disclosure of Interest Statement pursuant to Chapter 19, Section 19-9 of Town Code unless already on file and information has not changed; and be it further
RESOLVED, that all appointees shall file their Oath of Office with the Town Clerk of the Town of Beekman prior to serving their term.

RE: Appoint Alternate to Zoning Board of Appeals  
COUNCILMAN DEL VECCHIO         offers the following and moves for its adoption:   WHEREAS, Chapter 31 Article 1 of the Beekman Town Code states that alternate members may be appointed to the Planning and Zoning Boards in order to maintain a quorum; and   WHEREAS, there is a need to maintain a quorum for regularly scheduled Zoning Board of Appeals Meetings; and   WHEREAS, Chapter 31 -3 states that the Town Board may appoint alternate members to the Zoning Board of Appeals Board for a three (3) year term; now therefor be it   RESOLVED, that Sarah Davies be appointed as an alternate member to the Zoning Board of Appeals with a term to expire December 31, 2017.

COUNCILMAN STIEGLER           offers the following and moves for its adoption:
WHEREAS, authorization was given for the Town Clerk to advertise for bids for Highway Materials for 2015; and
WHEREAS, said bids were received, opened and read publicly on October 16, 2014 at 10:00am and have been reviewed by the Highway Superintendent and Town Clerk; now therefore be it
RESOLVED, that the bids are hereby awarded as recommended by the Highway Superintendent
as attached hereto.

RE: Reject Catch Basin Bid and Authorize Re-Bid of Catch Basin
COUNCILMAN BATTAGLINI         offers the following and moves for its adoption:
WHEREAS, on September 17, 2014 the Town Clerk was authorized to advertise a request to bid for Highway materials; and
WHEREAS, the bids were opened and received on October 16th, 2014 with the Town Clerk and Highway Superintendent; and
WHEREAS, only one (1) bid was received for Cast Iron Grates and Frames and zero (0) bids were received for Concrete Catch Basins; now therefore be it
RESOLVED, that the one (1) bid for the Cast Iron Grates and Frames from Sala and Sons Construction Inc. be rejected, as only one (1) bid was received; and be it further
RESOLVED, that the zero (0) bids for Concrete Catch Basins be rejected, as no bids were received; and be it further
RESOLVED, that the Town Clerk is hereby authorized to seek bids for Concrete Catch Basins and Cast Iron Grates and Frames.

RE: Authorize Town Clerk to Advertise a Request for Bids for Scrap Metal
SUPERVISOR ZULAUF               offers the following and moves for its adoption:
WHEREAS, the Town held its annual Clean-Up Day on October 25, 2014, and has received a sizeable volume of old equipment and materials that need to be disposed of; and
WHEREAS, the Highway Superintendent has recommended that these materials be sold for scrap as the materials cannot be used by the Highway Department; now therefore be it
RESOLVED, that the Town Board hereby authorizes the Town Clerk to advertise a request for bids for the sale and removal of scrap metal located at the Beekman Highway Department.

RESOLUTION NO. 11:05:14 – 9 (185)
RE: Approve County Highway Ice and Snow Program
COUNCILMAN DEL VECCHIO       offers the following and moves for its adoption:
WHEREAS, the Town Superintendent of Highways has been requested by the County of Dutchess to Participate in the Regional County Highway Snow and Ice Control Program within the boundaries of the Town; and
WHEREAS, the County of Dutchess is requesting that the Town enter into a contract with the County for participation in the County Snow and Ice Control Program; and
WHEREAS, and logically, an earlier or sooner response factor can be provided by Town units and personnel within the locale thereby benefiting the overall safety and welfare of town residents and local community interest; and
WHEREAS, such participation by the Town in removing snow from designated County Highways, and by sanding and salting or otherwise treating them for the purpose of maintaining highway safety and accessibility for emergency services, it specifically authorized by Article 6, Section 135-a of the New York State Highway Law; now therefor be it
RESOLVED, that the Town Supervisor is authorized to execute a contract for the Town’s participation in the County Snow and Ice Control Programs, and the Town Superintendent of Highways is herein authorized to perform such work in accordance with, and to receive payment as outlined in the Town and County contract for the County Snow and Ice Control Program for the Winter Season 2014-2015.

RESOLUTION NO. 11:05:14 –10 (186)
RE: Approve Bid for Playground Equipment
COUNCILMAN STIEGLER           offers the following and moves for its adoption:
WHEREAS, bids for playground equipment were received and opened publically October 27th at 10am; and
WHEREAS, these two (2) bids have been reviewed by Tom Harvey of Morris & Associates; and
WHEREAS, Tom Harvey has submitted his recommendation of the attached bids; and
WHEREAS, Miracle Recreation/Pettinelli Recreation Inc. submitted the lowest bid; now therefore be it
RESOLVED, that Miracle Recreation/Pettinelli Recreation Inc. be awarded the contract for building of the Playground Equipment, with a cost not to exceed $26,953.60; and be it further
RESOLVED, that the Supervisor be and hereby is authorized to execute any and all documents to carry out this service.

RESOLUTION NO. 11:05:14 – 11 (187)
RE: Authorize Purchase of 2016 Mack Truck for Highway
COUNCILMAN BATTAGLINI           offers the following and moves for its adoption:
WHEREAS, the Town is in need of a new truck for snow removal; and 
WHEREAS, two (2) bids were received for this truck; now therefore be it 
RESOLVED, that the Supervisor is hereby authorized to enter into an agreement with Beam Mack Sales and Service in Syracuse, NY 13057 for the purchase of the truck with a cost not to exceed $260,500; and be it further
RESOLVED, that the Town Board hereby directs the Town Comptroller to proceed to seek the most cost-efficient and fiscally sound financing proposals to purchase this vehicle.

RESOLUTION NO. 11:05:14 – 12 (188)
RE: Adoption to Amend Chapter 83 Section 5 for Flood Insurance Rate Map Revisions Local Law 5 2014
SUPERVISOR ZULAUF           offers the following and moves for its adoption:
WHEREAS, FEMA has revised the Flood Insurance Study Report and Flood Insurance Rate Map for the Town of Beekman; and
WHEREAS, Town Code must be amended to comply with these revisions; and
WHEREAS, a Public Hearing was held on October 15, 2014 at 7:00pm at Beekman Town Hall; and  
WHEREAS, no written comments were received through October 15, 2014; now therefor be it 
RESOLVED, that Chapter 83 Section 5 will be amended as per attached document and certified copies of this Local Law be filed immediately in the offices of the Beekman Town Clerk and New York Secretary of State.

RESOLUTION NO. 11:05:14 – 13 (189)
RE: To Sign SPCA Renewal Contract
COUNCILMAN DEL VECCHIO         offers the following and moves for its adoption:
WHEREAS, the Town of Beekman requires a location to house, shelter, and care for stray and lost dogs, which service is now performed by Dutchess County SPCA; and
WHEREAS, Dutchess County SPCA has submitted a proposal for the renewal of said services, for the coming calendar year, which proposal, the Board finds to be reasonable; and 
WHEREAS, the Town Attorney has reviewed the agreement with the SPCA; now therefore be it
RESOLVED, that the Town Board hereby authorizes the Supervisor to enter into an agreement, as attached, with SPCA to house, shelter, and care for stray dogs in the Town of Beekman.
