WHEREAS, Town Clerk Virginia Ward has provided copies of the minutes of the March 24, 2010 Beekman Town Board Meeting to all members of the Beekman Town Board; and

WHEREAS, Town Board members have had the opportunity to review said minutes; now therefore be it

RESOLUTION NO. 04:07:10 - 2  RE: Declaring April 24, 2010 “Girl Scout Spirit Day” in Beekman

COUNCILMAN PETER BARTON offers the following and moves its adoption:

WHEREAS, Girl Scouts of the USA (GSUSA) is the world’s preeminent organization dedicated solely to girls to provide strong programming and promote strong values, social conscience, civic responsibility, and personal skills; and

WHEREAS, the GSUSA have been active in the Town of Beekman and continue to play an integral role in our Town’s volunteer efforts, community, and youth development; and

WHEREAS, Girl Scouts Heart of the Hudson is active in the GSUSA and serves seven counties in southeastern New York State: Dutchess, Orange, Putnam, Rockland, Sullivan, Ulster and Westchester; and

WHEREAS, Girl Scouts Heart of the Hudson celebrates “Girl Scout Spirit Day” to promote Girl Scouts through community projects that they plan each year; and

WHEREAS, Girl Scouts Troops of Beekman are planting gardens at the Town Hall and the Beekman Library to spread awareness on Breast Cancer for the 2010 “Girl Scout Spirit Day;” and

WHEREAS, the Beekman Town Board recognizes the positive impact the Girl Scouts have had on the Beekman Community; now therefore be it

RESOLVED, that April 24, 2010 be declared “Girl Scout Spirit Day” in the Town of Beekman.

WHEREAS, William Goss filed his oath of office for the position of Deputy Highway Superintendent on January 17, 2008; and

WHEREAS, William Goss continues to act as Deputy Highway Superintendent for 2010; now therefore be it

RESOLVED, that a $170.00 per diem rate be established for the position of Deputy Highway Superintendent.

WHEREAS, deposits are required for tickets, shows and meals to guarantee the reservations and for which the Town is reimbursed through ticket sales; now therefore be it

RESOLUTION NO. 04:07:10 - 6 RE: Restoration insurance proceeds to the Town’s General Fund

COUNCILMAN PETER BARTON offers the following and moves its adoption:

WHEREAS, in August of 2009 the roof of one baseball field dugout at Town Center Park was destroyed by a storm, and

WHEREAS, the original materials cost to construct the dugout was approximately $4,000.00, and

WHEREAS, the original cost estimate to repair the damaged dugout, provided to the Town’s insurance carrier was $19,938.60, and

WHEREAS, the Town’s insurance carrier paid a claim to the Town in the amount of $11,225.24 in October of 2009, and

WHEREAS, the insurance claims proceeds were deposited in the Special Recreation Fund, and

WHEREAS, the Town Attorney has advised that these fund should have been retained in the Town’s General Fund, therefore be it

RESOLVED, that the Town Comptroller is hereby directed to take all necessary actions to transfer the insurance proceeds from the Special Recreation Fund to the Town General Fund.

RESOLUTION NO. 04:07:10 - 7 RE: Rescinding Ice Skating Rink Purchase

SUPERVISOR DANIEL J. FRENCH offers the following and moves its adoption:

WHEREAS, the Town Board passed resolution number 12:21:09-4 authorizing the use of Special Recreation Funds (SRF) funds for the purchase of a portable ice skating rink for a cost not to exceed $12,000; and

WHEREAS, while authorization for the purchase was given, it has not actually been purchased because the late December authorization prevented shipment for use during the 2009-2010 winter season (shipping was expected to take six weeks from the date of purchase); and

WHEREAS, the Town Board has determined that the $12,000 purchasing price, plus the cost for ongoing maintenance and supervision is too high given the current economic climate and many other demands on our recreation and maintenance resources; now therefore be it

RESOLVED, that the Town Board hereby rescinds resolution number 12:21:09-4, revoking authorization of the use of Special Recreation Funds (SRF) for the purchase of a portable ice skating rink.

RESOLUTION NO. 04:07:10 - 8 RE: Setting a Public Hearing to amend the Town Code,Sections 19-8 and 19-9 (Town Board of Ethics)

COUNCILMAN PETER BARTON offers the following and moves its adoption:

WHEREAS, the Town Board has considered amending the Ethics Code for the Town of Beekman, and

WHEREAS, §19 is amended to increase membership of the Ethics Board to 9 members; and further that §19 is amended to provide advisory board and ad hoc committees be required to complete a Disclosure of Interest Statement, and

WHEREAS, a draft copy of proposed Local Law No. 1 of 2010 amending the Town Ethics Code was reviewed by each Board Members at a Board Meeting held on April 7, 2010, now be it

RESOLVED, that the Board publish a Notice of Public Meeting to be held in accordance with the provision of Municipal Home Rule Law §20 to be held on the 21st day of April 2010 at 7:30 p.m. in the Town Hall Meeting Room, Beekman, New York, at which time all interested persons will be heard.

RESOLUTION NO. 04:07:10 - 9 RE: Authorizing Town financial support of Annual Fishing Derby Event

COUNCILMAN RON MANGERI offers the following and moves its adoption:

WHEREAS, the Poughquag Sportsman’s Club has organized and provided funding for the annual fishing derby in the Town of Beekman for many years; and

WHEREAS, the Poughquag Sportsman’s Club was unable to secure the entire funding needed for the 2010 fishing derby; and

WHEREAS, the Town Board feels that this is an important event that is well attended and enjoyed by Town of Beekman residents; now therefore be it

RESOLVED, that the Supervisor be and hereby is authorized to arrange the purchase of fish for the 2010 fishing derby for an amount not exceeding $1,500.00.

RESOLVED, that the Town Board of the Town of Beekman hereby authorizes the use of the Recreation Swim Area to be utilized by the Poughquag Sportsman’s Club on Saturday, April 17, 2010.
