RESOLUTION 9:23:02 - 1
RE: Appointments to the Conservation Advisory Council Tim Gotsch and Antonio Rivera Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, a Conservation Advisory Council was appointed January 18, 2000; and

WHEREAS, Chester Graves, Richard Lipitz and Anthony Pace have stepped down from their position; and

WHEREAS, the Town Board would like to re-activate the Conservation Advisory Counsel; now therefore let it be

RESOLVED, that Tim Gotsch and Antonio Rivera are hereby appointed to serve on the Conservation Advisory Council.

RESOLUTION 9:23:02 - 2 RE: Filling of Vacancy on Voluntary Board, Committee and Commission Councilwoman Santospirito offers the following and moves its adoption:

WHEREAS, the Town Board is required to fill vacancies occurring on any voluntary Board, Committee, and Commission, and

WHEREAS, the Town Board is desirous of affording all qualified residents an equal opportunity to serve on these voluntary Boards, Committees and Commissions, now therefore let it be

RESOLVED, that there shall be no automatic right of reappointment upon the expiration of any term on such Board, Committee and Commission, and be it further

RESOLVED, that upon the occurrence of a vacancy, the Supervisor shall announce, at the next succeeding Town Board meeting, that a vacancy exists and a Notice shall be placed in the Poughkeepsie Journal advising of the vacancy, and requesting the submission of a resume by an interested resident, including the person whose term on any such Board, Committee or Commission has expired and created the vacancy.

RESOLUTION 9:23:02 - 3 RE: Appointment to Recreation Commission Supervisor John Adams offers the following and moves its adoption:

WHEREAS, a vacancy exists on the Recreation Commission due to the resignation of William Thomas; and

WHEREAS, an ad was placed in the newspaper seeking interested individuals; and

WHEREAS, interviews were conducted for those individuals interested in serving on the Commission; now therefore be it

RESOLVED, that upon the recommendation of the Recreation Commission, Thomas Kinsley is hereby appointed to serve on the Recreation Commission with a term expiring on December 31, 2007.

RESOLUTION 9:23:02 - 4 RE: Repeal Resolution No. 01:03:02 - 6 Depository Account - Signature Authorization Councilman Peter Barton offers the following and moves its adoption:

WHEREAS, Town Law Section 29 (3) and Section 30 (9) requires that the Town Supervisor sign all checks disbursing Town monies, now therefore let it be

RESOLVED, that Resolution No. 01:03:02 -6 be hereby repealed, and that it is further

RESOLVED, that in compliance with Sections 29 (3) and Section 30(9) of Town Law, the Supervisor shall be the sole signatory on all checks disbursing Town monies, and be it further

RESOLVED, that pursuant to Town Law Section 42, if the office of Supervisor shall be vacant or if the Supervisor shall be absent or unable to serve, the Deputy Supervisor shall be the sole signatory on all checks disbursing Town monies.

*Amended: When two signatures are required on all checks exceeding $10,000, the Town Clerk may act as the second signatory.

RESOLUTION 9:23:02 - 5 RE: To Set Bond for John A. Giamo & Sons, Inc. Councilwoman Mauro offers the following and moves its adoption:

WHEREAS, the Town Engineer has prepared a Performance Bond Estimate, dated August 30, 2002, recommending the bond be set in the amount of $13,280.00 for John A. Giamo & Sons, Inc.; and

WHEREAS, the Planning Board adopted a resolution on September 19, 2002 to establish the bond amount as recommended by the Town Engineer; now therefore let it be

RESOLVED, that the Town Board hereby approves that the bond be set in the amount of $13,280.00 for John A. Giamo & Sons, Inc. and to be furnished by the applicant for filing in the office of the Town Clerk.
