RESOLUTION 3:05:07 - 1
RE: To Release Bond – Orr Estates, Section 1B

Supervisor John Adams offers the following and moves its adoption:

WHEREAS, a Performance Bond satisfactory to the Town Attorney in the amount of $229,000 has been provided to the Town of Beekman by the project sponsor; and

WHEREAS, the project sponsor has completed all of the bonded work; and

WHEREAS, the maintenance period of one year has passed; and

WHEREAS, the Town Engineer and the Highway Superintendent have inspected the site and have determined that the works for which the Performance Bond release are applied for have been installed in general compliance with the approved plans and specifications; now therefore be it

RESOLVED, that the Town Board hereby approves the release of the bond in the amount of $229,000.00.

RESOLUTION 3:05:07 - 2 RE: Authorizing Attendance at Retirement Seminar

Councilwoman Barbara Zulauf offers the following and moves its adoption:

WHEREAS, the Office of the State Comptroller’s Office is presenting an Employer Benefits Seminar on March 20, 2007 in Poughkeepsie; and

WHEREAS, attendance at this seminar, for which there is no fee, will be beneficial to the administrators of the New York State Retirement System for the Town; now therefore be it

RESOLVED, that Donna Shea and Yvonne Rodrigues are hereby authorized to attend said seminar.

RESOLUTION 3:05:07 - 3 RE: To Authorize Bids for Clean-Up Days

Councilman Daniel French offers the following and moves its adoption:

WHEREAS, the Town Board sees fit to offer the residents the opportunity to dispose of items that cannot be taken to the recycling center or discarded in the general trash; and

WHEREAS, Saturday, May 19 from 8 a.m. to 2:30 p.m. has been designated as Spring Clean-Up Day for 2007, and Saturday, October 13 from 8 a.m. to 2:30 p.m. for Fall Clean-Up Day; and

WHEREAS, participation is solely for Town of Beekman residents who show proof of residency with a valid Driver’s License; and

WHEREAS, NO garbage, hazardous material, brush or building materials will be accepted; and

WHEREAS, the attached fee schedule has been established and is available to the residents in the office of the Town Clerk; now therefore be it

RESOLVED, that the Town Clerk be and hereby is authorized to seek proposals for services for both clean-up days, to ensure the Town receives the best affordable prices.

RESOLUTION 3:05:07 - 4 RE: To Set Public Hearing on a Local Law Providing for the Administration & Enforcement of the New York State Uniform Fire Prevention & Building Code

Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, New York State Department of State Division of Code Enforcement and Administration has adopted new regulations effective January 1, 2007 for minimum standards for the administration and enforcement of the Uniform Code; and

WHEREAS, New York State mandates that every city, village, town and county, charged under subdivision 2 of section 381 of the Executive Law with administration and enforcement of the uniform Code shall provide for such administration and enforcement by local law; now therefore be it

RESOLVED, that a public hearing on a Local Law providing for the administration and enforcement of the New York State Uniform Fire Prevention and Building Code shall be held on the 2nd day of April, 2007 at 7:20 p.m. at the Town Hall, 4 Main Street, Poughquag, New York; and be it further

RESOLVED, that notice stating the time and place of such hearing and the purpose thereof, shall be published in the Poughkeepsie Journal, a newspaper circulating in the Town of Beekman, and posted on the signboard of the Town on or before the 22nd day of March, 2007.
