WHEREAS, Town Law provides that the Town Board may employ an attorney to provide such professional services and advice as the Town Board may require; and

WHEREAS, Local Law #1 of 2002 established the manner of compensation for the position of Attorney to the Town as a salaried employee; now therefore be it

RESOLVED, that Kevin Denton, Attorney at Law, be retained as the Attorney to the Town of Beekman for all matters at an annual salary of $77,500 and that the Supervisor be and hereby is authorized to execute an appropriate Letter of Engagement for such services.

RESOLUTION 1:09:06 - 6 RE: Appointment – Engineer to the Town Rhode, Soyka & Andrews

WHEREAS, the Town of Beekman is presented with important issues respecting future development and long-range planning requiring comprehensive analysis and coordination, now therefore be it

RESOLVED, that the firm of Rohde, Soyka & Andrews, Consulting Engineers, P.C., 40 Garden Street, Poughkeepsie, New York be retained on a contractual basis to provide Engineering and Planning services to the Town of Beekman for all matters, in accordance with the proposal dated December 19, 2005, and that the Supervisor be and hereby is authorized to sign attached Agreement.

RESOLUTION 1:09:06 - 7 RE: Authorizing Farmland Protection Grant Application Submission


Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, Thomas Sanford a Beekman landowner and the town have signed a letter of intent toward the sale of development rights of approximately ±300 acres of land to the Town of Beekman to protect prime farm soils and other agricultural resources on the property to under a permanent, agricultural conservation easement to be held by the Town of Beekman; and

WHEREAS, the New York State Department of Agriculture and Markets has announced a request for proposals for up to 75% state matching grant assistance of the total cost for agricultural and farmland protection projects, with a submittal deadline of January 23, 2006; and

WHEREAS, conservation of this farm is an important first step in implementing the town’s farmland protection element of the adopted open space plan, which plan specifically calls attention to this farm as a key area in the core farming area of the town and recommends the purchase of development rights as a conservation tool; and

WHEREAS, the acquisition of the conservation easement for the MacIntosh farm will help preserve the core agricultural areas within the Town of Beekman, will serve as model for conserving other agricultural properties, and may provide the impetus for other agricultural conservation easements in the area;

NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of Beekman authorizes the Town Supervisor to execute and file the Farmland Protection Grant application for matching funds from the New York State Department of Agriculture and Markets in accordance with the provisions of Agricultural and Farmland Protection Projects Program for FY 2005-2006; and upon approval of said grant request to enter into and execute a project agreement with the State for such financial assistance to the Town of Beekman for the purchase of development rights and the placement of an agricultural conservation easement on the subject farm.

BE IT FURTHER RESOLVED that the Town Board of the Town of Beekman authorizes and directs the Town Supervisor to take such steps as necessary to progress the farm protection project related matters pursuant to the Grant including but not limited to determination of the appropriate funding request and local match by the town.

RESOLUTION 1:09:06 - 10 RE: Meeting Schedule


Councilman Daniel French offers the following and moves its adoption:


Let it be RESOLVED, that the Regular Meetings of the Beekman Town Board will be conducted throughout the year 2006 at 7:30 PM on the first and third Monday of each month, with the exception of July and September, for which the meetings will be held on July 10 and July 24 and September 11 and September 25, respectively. The meetings will take place in the Meeting Room of the Beekman Town Hall, 4 Main Street, Poughquag, New York, with the exception of the June, July, August and September meetings which will be held at the Community Center on Recreation Road; and be it further

RESOLVED, should the date of such meeting fall on a holiday or at a time that is not possible to conduct the meeting, such as in the case of inclement weather, the meeting shall be held the following Monday at the same time.

RESOLUTION 1:09:06 - 11 RE: Mileage Compensation


Councilman Daniel French offers the following and moves its adoption:


WHEREAS, Town Law requires that the Town Board designate mileage compensation for official business; now therefore be it

RESOLVED, that compensation for mileage will be paid at the rate of forty four and a half cents ($.445) per mile on out of Town business, subject to prior authorization of the Town Board, excepting the Assessor, Assistant to the Building Inspector/Zoning Administrator and Dog Control Officers, who will be compensated for in Town mileage while utilizing their privately owned and insured vehicles for the performance of the duties of their office, and upon submission of the appropriate voucher, and be it further

RESOLVED, that all travel expense, transportation, lodging and meal expense will be reimbursed following prior authorization by the Town Board on out of town attendance at meetings.

RESOLUTION 1:09:06 - 14 RE: Reappointment of Planning Consultant

Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, Town Law states that the Town Board will make appointments and set salaries; and

WHEREAS, the Town has benefited by having a Planning Consultant review applications, assist in the preparation of planning projects, coordinate projects between the Planning Board and the Zoning Board and making recommendations that fulfill the requirements of the planning process; and

WHEREAS, Neal Townsend has occupied the position of Planning Consultant for the past two years; now therefore be it

RESOLVED, that Neal Townsend is hereby reappointed to the position of Planning Consultant at an hourly rate of $25.00 and not to exceed a total cost of $23,400.00.

RESOLUTION 1:09:06 - 15 RE: Adoption of Premium Only Plan

Councilman Thomas Kinsley offers the following and moves its adoption:

WHEREAS, on this date, the Town Board of the Town of Beekman did meet to discuss the implementation of Town of Beekman Section 125 Premium Only Plan to be effective January 1, 2006. Let it be known that the following resolutions were duly adopted by the Town Board of the Town of Beekman and that such resolutions have not been modified or rescinded as of the date hereof; now therefore let it be

RESOLVED, that the form of Premium Only Plan, as authorized under Section 125 of the Internal Revenue Code of 1986, presented to this meeting is hereby adopted and approved and that the proper officers of the Employer are hereby authorized and directed to execute and deliver to the Plan Administrator one or more copies of the Plan; and be it further

RESOLVED, that the Plan Year shall be for a 12 month period beginning on January 1st; and be it further

RESOLVED, that the Employer shall contribute to the Plan amounts sufficient to meet its obligation under the Premium Only Plan, in accordance with the terms of the Plan Document and shall notify the Plan Administrator to which periods said contributions shall be applied; and be it further

RESOLVED, that the proper officers of the Employer shall act as soon as possible to notify employees of the adoption of the Premium Only Plan by delivering to each Employee a copy of the Summary Plan Description presented to this meeting, which form is hereby approved; and be it further

RESOLVED, that the undersigned certifies that attached hereto as Exhibit A and B respectively are true copies of Town of Beekman Section 125 Premium Only Plan, Plan Document, and Summary Plan Description approved and adopted in the foregoing resolutions; and be it further

RESOLVED, that the undersigned further certifies and attests that the above resolutions were made with the consent of the full Town Board of the Town of Beekman, each of whom were in attendance on this date.

RESOLUTION 1:09:06 - 19 RE: Appointment of Special Engineer to the Highway Superintendent – Thomas Llanes


Councilman Thomas Kinsley offers the following and moves its adoption:


WHEREAS, Highway Law Sect. 140(19) states that the Highway Superintendent has the power to employ an engineer subject to approval of the Town Board; and

WHEREAS, the monies for this position have been appropriated in the amount of $6,000.00 in the 2006 Town budget in Account No. 5020.4 of the Highway Fund; now therefore be it

RESOLVED, that Thomas Llanes is hereby appointed to the position of Special Engineer to the Highway Superintendent at a rate of $70 per hour, to a maximum annual expense of $6,000.00.

RESOLVED, that retention of Vanacore, DeBenedictus, DiGovanni & Weddell, LLP, 341 Manchester Road, Poughkeespie, New York, be continued in accordance with Vanacore’s proposal dated November 30, 2005 and that the Supervisor be and hereby is authorized to execute an appropriate retention agreement for services.
