RESOLVED, that the Town Board hereby makes the following appointments to be effective immediately:

WHEREAS, the developer for the Meadow Brook Manor Subdivision has made application for the construction of 20 single family homes located on Gardner Hollow Road in the Town of Beekman; and WHEREAS, the Town of Beekman Planning Board recommends that it is in the best interest of the Town and the applicant to use a planning consultant to assist the Planning Board in the performance of a coordinated SEQRA review; now therefore be it RESOLVED, that Mr. Arthur Brod of Planners East, Inc., who also advises the Planning Board on other projects in the Town, be and hereby is appointed as the Planning Board SEQRA consultant for the Meadow Brook Manor Subdivision Project; and be it further RESOLVED, that Mr. Brod’s professional fees will be paid from the developer’s escrow account established for this project.

RESOLUTION 1:22:07 - 3 RESOLUTION # ___ OF 2007 AUTHORIZING THE TOWN OF BEEKMAN TO CONTRIBUTE TWO MILLION DOLLARS ($2,000,000) TO PURCHASE THE DEVELOPMENT RIGHTS ON THE MCINTOSH FARM PROPERTY WHEREAS, the Town of Beekman is committed to partnering with Dutchess County and Dutchess Land Conservancy to purchase the development rights on the 305-acre McIntosh Farm property, also known as Thomas T. Sanford’s property, on State Highway Route 216, Brill Lane, Morgan Lane and Frog Hollow Road in the Town of Beekman. WHEREAS, the total purchase price for the development rights on the McIntosh Farm property is two million, seven hundred and thirty-nine thousand and five hundred dollars ($2,739,500). WHEREAS, the Town of Beekman will submit an application to Dutchess County, through the Dutchess County Partnership For Manageable Growth/Open Space and Farmland Protection Matching Grant Program, for an amount not to exceed five hundred and twenty-nine thousand dollars ($529,000) toward the costs of purchasing the development rights on the McIntosh Farm property. WHEREAS, Mr. Sanford has demonstrated his commitment to the project and has agreed to a bargain sale reduction of two hundred thousand dollars ($200,000) off of the value of the development rights for the property. WHEREAS, Dutchess Land Conservancy will donate in-kind costs and services of ten thousand five hundred dollars ($10,500) to the project. WHEREAS, the New York State Constitution states that the policy of the state is to encourage the development and improvement of agricultural lands for the production of food and agricultural products. WHEREAS, purchasing the development rights on the McIntosh Farm property and the preservation of the agricultural use of the property, is consistent with Article 25-AAA, Section 321 of the Agriculture and Markets Law, which declares agricultural lands to be irreplaceable. WHEREAS, purchasing the development rights on the McIntosh Farm property is consistent with the Town of Beekman’s Comprehensive Plan’s goal to preserve open spaces, farmlands and woodlots, which are key components of the Town’s rural character. WHEREAS, purchasing the development rights on the McIntosh Farm property is consistent with the Town of Beekman’s Open Space Plan’s goal to keep farming in the valley. WHEREAS, the Dutchess County Legislature, in the County Master Plan Directions, encourages the protection of prime and important agricultural soils and supports the use of conservation easement to preserve agricultural lands in rural areas. WHEREAS, acquiring the development rights on the McIntosh Farm property will protect the agricultural and scenic values of the McIntosh Farm and the Town of Beekman. NOW, THEREFORE, BE IT RESOLVED That the Town of Beekman commits to a two million dollar ($2,000,000.00) funding commitment for the project. Motion made by: Councilman Werner Stiegler ROLL CALL VOTE:
RESOLUTION 1:22:07 - 4 RE: Authorizing 2007 Dial-A-Ride Contract Renewals Councilman Daniel French offers the following and moves its adoption: WHEREAS, the Town of Beekman participates in the Dial-A-Ride Transportation System for senior citizens; and WHEREAS, the 2007 budget provides for the cost of this program not to exceed $9,978.96; now therefore be it RESOLVED, that the Supervisor be and hereby is authorized to sign the 2007 Dial-A-Ride Contract Renewals.
ROLL CALL VOTE: RESOLUTION 1:22:07 - 5 RE: To Award Bids for 2007 Highway Materials
WHEREAS, said bids were received, opened and read publicly on December 28, 2006 and have been reviewed by the Highway Superintendent; now therefore be it RESOLVED, that the bids are hereby awarded as recommended by the Highway Superintendent as attached herewith.

RESOLUTION 1:22:07 - 6 RE: Authorizing Internal Audit of Department Financial Records By the Comptroller Councilman Werner Stiegler offers the following and moves its adoption:
WHEREAS, in lieu of said examination, an audit of these books and records can be conducted by the Town Comptroller; now therefore be it RESOLVED, that the Town Board hereby requests and authorizes the Town Comptroller to audit the books and records of Town Clerk, Receiver of Taxes, Justice Court and Building Department for the fiscal year of 2006; and be it further RESOLVED, that said internal audit will be conducted by the Town Comptroller every two years.

WHEREAS, the Planning Board has adopted a resolution on December 21, 2006 to establish the bond amount as recommended by Rhode, Soyka and Andrews Engineers; now therefore be it RESOLVED, that the Town Board hereby approves that the bond be set in the amount of $335,000.00 for Lansbrook Meadow Subdivision and to be furnished by the applicant for filing in the office of the Town Clerk. RESOLUTION 1:22:07 - 8 RE: Bond Reduction for Mountain View III Subdivision Councilman Daniel French offers the following and moves its adoption:
WHEREAS, a Performance Bond in the amount of $200,000.00 was provided to the Town of Beekman on the Mountain View III Subdivision Project; and WHEREAS, certain portions of the bonded work for Mountain View III Subdivision have been completed; and WHEREAS, the Town Engineer has inspected the site and has determined that the works for which a Performance Bond reduction are applied for have been installed in general compliance with the approved plans and specifications; and WHEREAS, the Town Engineer has assigned the value of the remaining work to be completed at $83,500.00; and WHEREAS, at the November 30, 2006 Planning Board meeting the bond reduction was approved; and WHEREAS, the Planning Board recommends that the Town Board approve a reduction in Performance Bond of $116,500.00; now therefore be it RESOLVED, that the Town Board approves the reduction in Performance Bond of $116,500.00 for Mountain View III Subdivision and authorizes the applicant to substitute the current bond on file in the office of the Town Clerk with the new Performance Bond in the amount of $83,500.00.

WHEREAS, Pesticide Training & Consulting will be offering training courses on January 26, 2007 and February 6, 2007 in Latham, NY and Newburgh, NY, respectively; and WHEREAS, said courses will offer an opportunity for the Maintenance Mechanic to renew his pesticide license; and WHEREAS, the cost of $115.00 per course is included in the 2007 budget; now therefore be it RESOLVED, that Greg Brown is hereby authorized to attend the two pesticide training courses. WHEREAS, the Town contracted with a vendor for the operation of the concession stand at Recreation Park for the 2006 season; and WHEREAS, the Recreation Commission is desirous in entering into a contract again for the 2007 season; now therefore be it RESOLVED, that the Town Board of the Town of Beekman hereby authorizes the Recreation Director to place an advertisement in the Poughkeepsie Journal for Requests for Proposals for the concession stand at Recreation Park. RESOLUTION 1:22:07 - 11 RE: Authorizing Senior Trip Councilwoman Barbara Zulauf offers the following and moves its adoption:
WHEREAS, funding has been included in the 2007 budget; now therefore be it RESOLVED, that payment for the charter of a bus at a cost of $995.00 as well as the required deposits for the play and meal are hereby authorized.

RESOLUTION 1:22:07 - 12 RE: To Set Hearing For Disabled Persons Partial Tax Exemption
WHEREAS, Section 459-c of the New York State Property Tax Law (“RPTL”) authorizes any municipal corporation pursuant to local law, ordinance or resolution to set the income eligibility level for a partial exemption from the taxation of real property owned by persons with disabilities and limited income; and WHEREAS, the Town of Beekman Assessor’s Office recommends that increasing the income eligibility level to the maximum permitted under the Real Property Tax Law would have a minor impact on the taxable real property tax base of the Town of Beekman; now therefore be it RESOLVED, that pursuant to Section 130 of the Town Law, a public hearing on a proposed amendment to Chapter 135, Article III of the Code of the Town of Beekman to increase the eligibility level for a partial exemption for the taxation of real property owned by persons with disabilities and limited income be held on the 5th day of February, 2007 at 7:10 o’clock p.m. at the Town Hall, 4 Main Street, Poughquag, in the Town of Beekman, New York, and that notice of the time and place of such hearing and setting forth the proposed amendment be published once on or before the 25th day of January, 2007 in the Poughkeepsie Journal, a newspaper circulating in the Town of Beekman.

WHEREAS, the Town of Beekman Assessor’s Office recommends that increasing the income eligibility level to the maximum permitted under the Real Property Tax Law would have a minor impact on the taxable real property tax base of the Town of Beekman; now therefore be it RESOLVED, that pursuant to Section 130 of the Town Law, a public hearing on a proposed amendment to Chapter 135, Article III of the Code of the Town of Beekman to increase the eligibility level for a partial exemption for the taxation of real property owned by senior citizens with a limited income be held on the 5th Day of February, 2007 at 7 o’clock p.m. at the Town Hall, 4 Main Street, Poughquag, in the Town of Beekman, New York, and that notice of the time and place of such hearing and setting forth the proposed amendment be published once on or before the 25th day of January, 2007 in the Poughkeepsie Journal, a newspaper circulating in the Town of Beekman.
