RESOLUTION 2:02:04 - 1 RE: To Authorize Bids for Clean-Up Days Councilwoman Barbra Zulauf offers the following and moves its adoption:

WHEREAS, the Town Board sees fit to offer the residents the opportunity to dispose of items that cannot be taken to the recycling center or discarded in the general trash; and

WHEREAS, Saturday, May 15th from 8 a.m. to 2:30 p.m. has been designated as Spring Clean-Up Day for 2004, and Saturday, October 16th from 8 a.m. to 2:30 p.m. for Fall Clean-Up Day; and

WHEREAS, participation is for Town of Beekman residents only who show proof of residency with a valid Driver's License; and

WHEREAS, NO garbage, hazardous material, brush or building materials will be accepted; and

WHEREAS, a fee schedule will be established and available to the residents in the office of the Town Clerk; now therefore be it

RESOLVED, that the Town Clerk be and hereby authorized to seek proposals for said services, to ensure the Town receives the best affordable prices.

RESOLUTION 2:02:04 - 2 RE: Bid Award - 2004 Highway Materials Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, authorization was given for the Town Clerk to advertise for Highway Materials for 2004; and

WHEREAS, said bids were received, opened and read publicly on January 21st and have been reviewed by the Highway Superintendent, now therefore be it

RESOLVED, that the bids are hereby awarded as recommended by the Highway Superintendent as attached herewith.

RESOLUTION 2:02:04 - 3 RE: Authorizing Attendance at Landscape Training Conference Councilman Thomas Kinsley offers the following and moves its adoption:

WHEREAS, the New York State Turfgrass Association is holding a Landscape Technician Training Conference on February 23, 2004 in Tarrytown, New York; and

WHEREAS, attendance at this conference will be beneficial for the maintenance and landscaping of the lawns and sports turf owned by the Town; and

WHEREAS, the Maintenance Mechanic, Gregory Brown, will receive continuing education credits required for recertification; and

WHEREAS, the cost of $85.00 per person is included in the 2004 budget; now therefore be it

RESOLVED, that Gregory Brown and Wayne Monroe are hereby authorized to attend said conference.

RESOLUTION 2:02:04 - 5 RE: To Set Public Hearing Renewing Moratorium On Planning Approvals Within the Town Center Area Supervisor John Adams offers the following and moves its adoption:

WHEREAS, the Local Law imposing a moratorium on planning approvals within the Town Center Area will expire on the 29th day of February, 2004; and

WHEREAS, the Town Board has determined that a moratorium needs to remain in place in order to accomplish the goals set forth in Local Law #1 of 2003; now therefore be it

RESOLVED, that a public hearing on the attached local law renewing said moratorium shall be held on the 23rd day of February, 2004 at 7:20 PM at the Town Hall, 4 Main Street, Poughquag, New York; and be it further

RESOLVED, that notice stating the time and place of such hearing and the purpose thereof, shall be published in the Poughkeepsie Journal, a newspaper circulating in the Town of Beekman, and posted on the signboard of the Town on or before the 13th day of February, 2004.

RESOLUTION 2:02:04 - 6 RE: Appointment of Support Staff For Archive Grant Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, the Town has been awarded a Records Management Improvement Fund grant; and

WHEREAS, funding includes the hiring of two part-time inventory clerks; and WHEREAS, currently only one inventory clerk has been appointed; and

WHEREAS, the Town Board is authorized under Town Law to make all appointments; now therefore be it

RESOLVED, that the following appointment be made:

  • Laura Balcom - Part-Time Inventory Clerk

And be it further RESOLVED, that the total amount budgeted for part-time records inventory clerks shall not exceed $12,500.

RESOLUTION 2:02:04 - 7 RE: Establishing a Records Management Program Councilman Thomas Kinsley offers the following and moves its adoption:

WHEREAS, Section 57.13 of the Local Government Records Law states that "public records are essential to the administration of local government…(and) such records need to be systematically managed to ensure ready access to vital information and to promote efficient and economical operation of government"; and

WHEREAS, Section 57.19 of said law requires Town Boards to "promote and support" a Records Management Program; and

WHEREAS, establishing a Records Management Program will strengthen the Town's position for future grant funding through the New York State Archives; now therefore be it

RESOLVED, that the Town Board hereby approves the attached Records Management Program be established for the Town of Beekman.

RESOLUTION 2:02:04 - 8 RE: Rescinding Public Hearing for Local Law #2 of 2004 Naming of Records Management Officer and Establishing Program Councilwoman Barbara Zulauf offers the following and moves its adoption:

WHEREAS, under section 57.19 of the Local Government Records Law the Town Board is required to "promote and support" a Records Management Program and designates the Town Clerk as the Records Management Officer (RMO) of the Town; now therefore be it

RESOLVED, that the public hearing scheduled for the 1st day of March, 2004 on a proposed local law creating a Records Management Program and naming the Records Management Officer is hereby rescinded.

RESOLUTION 2:02:04 - 9 RE: To Set Timing for Acceptance of Roads Supervisor John Adams offers the following and moves its adoption:

WHEREAS, from time to time the Town Board has occasion to accept as town highways subdivision roads which have been completed to Town specifications; and

WHEREAS, the process leading up to acceptance requires the Town Engineer and Town Highway Superintendent to examine the road itself, "as built" surveys, and other engineering materials to confirm its conformance with Town specifications and to recommend a maintenance bond amount, and requires the Attorney to the Town to examine title materials, proposed deeds and attendant conveyance documents for the road itself as well as related drainage or other easements; and

WHEREAS, these responsibilities are best taken up in a methodical and unhurried manner in order to insure that all roads are accepted in proper conditions and with the appropriate documents; and

WHEREAS, acceptance of a new town highway too late in the year can result in town funds being expended for snow plowing and sanding which have not been considered in that year's budget; now therefore be it

RESOLVED, that the Town of Beekman shall not accept any new road as a Town Highway later than September 15 or earlier than the next March 15.
