RESOLUTION 2:26:07 - 1 RE: Appointing Special Planning Consultant for Grape Hollow Subdivisions
WHEREAS, said subdivisions are contained in the two townships of Beekman and Pawling as well as borders on Agricultural property; and WHEREAS, the Town of Beekman Planning Board recommends that it is in the best interest of the Town and the applicant to use a planning consultant to assist the Planning Board in the performance of the coordinated SEQRA review through the preliminary planning stage; now therefore be it RESOLVED, that Mr. Arthur Brod of Planners East, Inc., who also advises the Planning Board on other projects in the Town, be and hereby is appointed as the Planning Board SEQRA consultant for the Grape Hollow Subdivisions Project; and be it further RESOLVED, that Mr. Brod’s professional fees will be paid from the developer’s escrow account established for this project.

WHEREAS, a proposed Local Law to impose a six-month moratorium on planning approvals in the Poughquag Hamlet was introduced on February 26, 2007 with a public hearing being duly held before the Town Board; now therefore be it RESOLVED, that said Local Law imposing a moratorium on planning approvals in the Poughquag Hamlet, be and hereby is enacted by the Town Board of the Town of Beekman; and be it further RESOLVED, that certified copies of this Local Law be filed immediately in the offices of the Beekman Town Clerk and the New York Secretary of State. RESOLUTION 2:26:07 - 3 RE: Local Law No. ___ of 2007 Increase Levels for Persons with Disabilities and Limited Incomes
Councilman Werner Stiegler offers the following and moves its adoption: WHEREAS, Real Property Tax Law has increased eligibility ceilings by $2,000 for Persons with Disabilities and Limited Incomes Tax Exemption pursuant to §459-c of the New York State Property Tax Law, which authorizes any municipal corporation pursuant to local law, ordinance or resolution to set the income eligibility level for a partial exemption from the taxation of real property owned by persons with disabilities and limited income; and WHEREAS, the Town of Beekman Assessor’s Office recommends that increasing the income eligibility level to the maximum permitted under the Real Property Tax Law would have a minor impact on the taxable real property tax base of the Town of Beekman, now therefore, having complied with the provisions of Section 130 of the Town Law, BE IT ENACTED by the Town Board of the Town of Beekman, County of Dutchess, State of New York, that §135-4 of Chapter 135, Article III of the Code of the Town of Beekman be and hereby is amended to increase the income eligibility level for a partial exemption for the taxation of real property owned by persons with disabilities and limited incomes by $2,000 in each exemption category, so as to read as set forth on the attached schedule.

RESOLUTION 2:26:07 - 4 RE: Local Law No. __ of 2007 Increase Levels for Senior Citizen Tax Exemption
Councilman Daniel French offers the following and moves its adoption:
WHEREAS, the Town of Beekman Assessor’s Office recommends that increasing the income eligibility level to the maximum permitted under the Real Property Tax Law would have a minor impact on the taxable real property tax base of the Town of Beekman, now therefore, having complied with the provisions of Section 130 of the Town Law, BE IT ENACTED by the Town Board of the Town of Beekman, County of Dutchess, State of New York, that §135-4 of Chapter 135, Article III of the Code of the Town of Beekman be and hereby is amended to increase the income eligibility level for a partial exemption for the taxation of real property owned by senior citizens by $2,000 in each exemption category, so as to read as set forth on the attached schedule.

RESOLUTION 2:26:07 - 5 RE: Authorizing SRF Funds for Metes & Bounds Legal Description for Recreation Road Easement Councilwoman Barbara Zulauf offers the following and moves its adoption:
WHEREAS, it is necessary to provide Dutchess County Water and Wastewater Authority with a Metes and Bounds Legal Description of the easement as part of this agreement; and WHEREAS, the cost to calculate and map the easement by Link Surveyors, who were previously authorized to survey and stake out the westerly Right-of-Way line of Recreation Road for this project, is $525.00; now therefore be it RESOLVED, that the Town Board hereby authorizes the expenditure of $525.00 for the Metes and Bounds Legal Description from the Special Recreation Funds (SRF). RESOLUTION 2:26:07 - 6 RE: To Award Bid – Tree Work Councilwoman Barbara Zulauf offers the following and moves its adoption: WHEREAS, authorization was given for the Town Clerk to advertise for Highway Materials including annual tree work; and WHEREAS, bids for annual tree work were received, opened and read publicly on February 21, 2007 in the office of the Town Clerk and reviewed by the Highway Superintendent and herewith attached; now therefore be it RESOLVED, that the bid for annual tree work is hereby awarded to:

RESOLUTION 2:26:07 - 7 RE: Local Law No. ____ of 2007 Increasing Levels of Veterans Tax Exemption
WHEREAS, Real Property Tax Law has increased the eligibility ceilings for persons who rendered military service to the United States tax exemption pursuant to §458-a of the New York State Property Tax Law, which authorizes any municipal corporation pursuant to local law, ordinance or resolution to set the income eligibility level for a partial exemption from the taxation of real property owned by person who rendered military service to the United States; and WHEREAS, the Town of Beekman Assessor’s Office recommends that increasing the income eligibility level to the maximum permitted under the Real Property Tax Law would have a minor impact on the taxable real property tax base of the Town of Beekman, now therefore, having complied with the provisions of Section 130 of the Town Law, BE IT ENACTED by the Town Board of the Town of Beekman, County of Dutchess, State of New York, that §135-2 of Chapter 135, Article II of the Code of the Town of Beekman be and hereby is amended to increase the income eligibility level for a partial exemption for the taxation of real property owned by persons who rendered military service to the United States in each exemption category, so as to read as set forth on the attached schedule.
