RESOLUTION 3:3:08 - 1 RE: Authorizing Assessor to Attend Training Class

Councilman Daniel French offers the following and moves its adoption:


WHEREAS, the Office of Real Property Services will be holding an Ethics Training Class in Millbrook on April 4, 2008 at no cost to the Town; now therefore be it

RESOLVED, that Jon Barrett is hereby authorized to attend the ethics training class.

RESOLUTION 3:3:08 - 2 RE: Gazivoda Litigation


Councilwoman Barbara Zulauf offers the following and moves its adoption:


WHEREAS, a Stipulation of Settlement has been issued in the suit Beekman vs Deda Gazivoda and Lula Gazivoda by the Supreme Court of the State of New York, County of Dutchess; now therefore be it

RESOLVED, that the Town Board hereby authorizes the settlement of the above suit and hereby authorizes the Town Attorney and the Town Supervisor to execute the attached settlement.

RESOLUTION 3:3:08 - 3 RE: To Award Tractor Bid for the Highway Department


Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, the Town Clerk was authorized to seek bids for a new tractor; and

WHEREAS, the following bids were received, opened and read publicly on February 21, 2008;

Keil Equipment Company, Inc. $88,428

Milton Caterpillar – Option A $78,326
Milton Caterpillar – Option B $80,840

Now therefore be it RESOLVED, that the bid is hereby awarded to Keil Equipment Company, Inc. for a John Deere 5525 tractor and Alamo-Industrial Versa Boom Mowing System at a cost of $88,428.00; and be it further

RESOLVED, that this expenditure will be made from the “Highway Equipment Capital Reserve Fund”; and be it further

RESOLVED, that the Town Clerk is directed to place the required legal notices in accordance with the permissive referendum requirements established for the “Highway Capital Reserve Fund”.

RESOLUTION 3:3:08 - 4 RE: Authorizing Professional Planning Services Contract

Supervisor John Adams offers the following and moves its adoption:


WHEREAS, Curt Lavalla is currently the Town Planner for the Town of Beekman; and

WHEREAS, the Town Board would like to continue to utilize Mr. Lavalla’s professional planning services, which will now become available through LaBerge Group effective March 1, 2008; now therefore be it

RESOLVED, that the Town Board hereby authorizes the Supervisor to enter into an agreement between the Town of Beekman and Laberge Group for professional planning services in accordance with the attached contract.
