3:07:05 - 1 Appointments RESOLUTION 3:07:05 - 1 RE: Appointments Councilman Daniel French offers the following and moves its adoption: WHEREAS, vacancies exist on the various boards serving the Town of Beekman due to expiration of terms; and WHEREAS, vacancies have been announced and published followed by interviews of all interested candidates; now therefore be it RESOLVED, that the Town Board hereby makes the following appointments:
And be it further RESOLVED, that Sarah Davis hereby is appointed as Chairperson of the Zoning Board of Appeals; and be it further RESOLVED, that all appointments are contingent upon completion and submission of a Disclosure of Interest Statement pursuant to Chapter 19, Section 19-9 of Town Code; and be it further RESOLVED, that all appointees will file their Oath of Office with the Town Clerk of the Town of Beekman prior to serving in their respective positions. RESOLUTION 3:07:05 - 2 RE: To Authorize Bids for Clean-Up Days Councilman Thomas Kinsley offers the following and moves its adoption: WHEREAS, the Town Board sees fit to offer the residents the opportunity to dispose of items that cannot be taken to the recycling center or discarded in the general trash; and WHEREAS, Saturday, May 14 from 8 a.m. to 2:30 p.m. has been designated as Spring Clean-Up Day for 2005, and Saturday, October 15 from 8 a.m. to 2:30 p.m. for Fall Clean-Up Day; and WHEREAS, participation is solely for Town of Beekman residents who show proof of residency with a valid Driver’s License; and WHEREAS, NO garbage, hazardous material, brush or building materials will be accepted; and WHEREAS, the attached fee schedule has been established and is available to the residents in the office of the Town Clerk; now therefore be it RESOLVED, that the Town Clerk be and hereby is authorized to seek proposals for services for both clean-up days, to ensure the Town receives the best affordable prices. RESOLUTION 3:07:05 - 3 RE: Issuance of Negative Declaration Rezoning of Lands from C-2 to TC (Town Center Area) Supervisor John D. Adams offers the following and moves its adoption: WHEREAS, the Town Board of the Town of Beekman has proposed a Local Law for the rezoning of 132 acres to create the Town Center (TC) zone and rezone certain properties from C-2 to TC; and WHEREAS, this Action is subject to review pursuant to Article 8 of the New York State Environmental Conservation Law and 6 NYCRR Part 617, together commonly known as the New York State Environmental Quality Review Act (“SEQRA”) and by resolution adopted on November 1, 2004, the Town Board made certain determinations concerning this Action, including the Town Board’s intent to act as lead agency and authorizing the preparation of a Full Environmental Assessment Form; and WHEREAS, the Town Board has, by Resolution adopted December 6, 2004, declared lead agency and authorized a public hearing, which was duly noticed and held on December 20, 2004 and continued on February 7, 2005; and WHEREAS, having considered the environmental impacts of the Actions, it is the desire and intent of the Town Board to authorize and approve the annexed Negative Declaration, Notice of Determination of Non-Significance with regards to rezoning of said lands; now therefore be it RESOLVED, that the Town Board of the Town of Beekman hereby authorizes and approves the Negative Declaration, Notice of Determination of Non-Significance with regard to the rezoning of 132 acres, to be known as the Town Center area, in the same form and substance as annexed hereto; and be it further RESOLVED, that the Town Supervisor be and hereby is authorized and empowered to take all steps necessary, including the filing and noticing of the authorization and approval of the Negative Declaration in accordance with 6NYCRR 617 to implement this resolution. RESOLUTION 3:07:05 - 4 RE: Enactment of Local Law No. 2 Rezoning of Lands from C-2 to TC Establishing the Town Center Councilwoman Barbara Zulauf offers the following and moves its adoption: WHEREAS, the Town Board of the Town of Beekman has proposed a Local Law for the rezoning of 132 acres to create the Town Center (TC) zone and rezone certain properties from C-2 to TC; and WHEREAS, this Action is subject to review pursuant to Article 8 of the New York State Environmental Conservation Law and 6 NYCRR Part 617, together commonly known as the New York State Environmental Quality Review Act (“SEQRA”), and the Town Board has by official action undertaken such review; and WHEREAS, having considered the environmental impacts of this Action, it is the desire and intent of the Town Board to adopt and approve the rezoning of lands establishing the Town Center Area; now therefore be it RESOLVED, that the Town Board of the Town of Beekman hereby authorizes and approves Local Law No. 2 of 2005 rezoning lands from C-2 to TC establishing the Town Center Area, in the same form and substance as presented to this meeting; and be it further RESOLVED, that the Town Supervisor be and hereby is authorized to take
all steps RESOLVED, that this Local Law shall take effective immediately upon its filing with the Secretary of State. RESOLUTION 3:07:05 - 5 RE: To Set Bond for Gallagher Subdivision Councilman Daniel French offers the following and moves its adoption: WHEREAS, Rhode, Soyka and Andrews Consulting Engineers, P.C. has prepared a Performance Bond Estimate dated February 17, 2005, recommending the bond be set in the amount of $50,130.00 for Gallagher Subdivision; and WHEREAS, the Planning Board adopted a resolution on February 24, 2005 to establish the bond amount as recommended by Rhode, Soyka and Andrews Engineering; now therefore be it RESOLVED, that the Town Board hereby approves that the bond be set in the amount of $50,130.00 for Gallagher Subdivision and to be furnished by the applicant for filing in the office of the Town Clerk. Adams offers the following and moves its adoption: WHEREAS, there exists a zoning violation of property zoned as a single family dwelling owned by Mr. Deda Gazivoda and/or Lula Gazivoda; and WHEREAS, based upon the recommendation of the Town’s Code Enforcement Officer, it is necessary that our Town Attorney pursue this violation of an illegally occupied three apartment house; now therefore be it RESOLVED, that Kevin Denton, Attorney to the Town of Beekman, is hereby authorized to bring action to the Supreme Court for an injunction against further building and zoning violations of the property owned by Mr. Deda Gazivoda and/or Lula Gazivoda. RESOLUTION 3:07:05 - 8 RE: Music for Memorial Day Service Councilwoman Barbara Zulauf offers the following and moves its adoption: WHEREAS, the Town of Beekman holds a Memorial Day service and parade each year to honor veterans who have served and are currently serving our country; now therefore be it RESOLVED, that the Supervisor be and hereby is authorized to enter into a contract with the Royal Court of Dover Drum & Bugle for their participation in our service on Monday, May 30, 2005 at a cost of $800.00. RESOLUTION 3:07:05 - 9 RE: To Declare Lead Agency and Set Public Hearing on Open Space Plan for the Town of Beekman Councilman Werner Stiegler offers the following and moves its adoption: WHEREAS, the Town of Beekman previously adopted a Town of Beekman Comprehensive Plan in 1999 that recommended an open space plan be developed; and subsequently the town authorized and appointed a town open space planning committee in 2004 to lead a planning effort and to engage community members including landowners for their input and involvement, with assistance from a community planning and open space conservation planning advisor to prepare an open space plan as an element of the town’s comprehensive planning for the town’s resources; and, WHEREAS, the town’s open space committee has submitted a draft open space plan to the town board for the town board’s review that defines a town vision for open space protection, sets short term and long term goals and actions, and recommends conserving some of the most important resources that landowners and the Beekman community are mutually interested in protecting. The draft open space plan, dated February 2005, is available for public review on the town’s website at www.townofbeekman.com; and, WHEREAS, the Town Board is the single agency involved in the potential adoption of the open space plan, and thus will be the Lead Agency under the State Environmental Quality Review Act (SEQR), and will make directly available the draft open space plan to the potentially Interested Agencies of the Town of Beekman Planning Board and the Dutchess County Department of Planning and Economic Development; and, WHEREAS, the town’s open space planning advisors, Behan Planning Associates, LLC have prepared a Full EAF on the proposed action of adopting the draft open space plan on behalf of the Town of Beekman Town Board for the Town Board’s review; now therefore be it RESOLVED, that the Town of Beekman Town Board hereby declares itself to be Lead Agency; hereby accepts the Full EAF for further review; and determines that the project as described is subject to the State Environmental Quality Review Act (SEQR) as a Type I action for the purpose of an environmental review pursuant to 6 NYCRR Part §617.6 (b) (3) of the State Environmental Quality Review Act (SEQR); and be it further RESOLVED, that the Town of Beekman Town Board hereby sets a public hearing on the proposed action under environmental review, for Monday, March 21 at 7:20 p.m. at the Town of Beekman Town Hall, 4 Main Street, Poughquag, New York. RESOLUTION 3:07:05 - 10 RE: To Request NYS DOT to Authorize a Speed Reduction on South Greenhaven Road Councilman Thomas Kinsley offers the following and moves its adoption: WHEREAS, South Greenhaven Road is experiencing a tremendous amount of vehicles travelling at excessive rates of speed; and WHEREAS, the Town Board of the Town of Beekman recommends a speed reduction for this roadway; now therefore be it RESOLVED, that the Town Board hereby requests the New York State Department of Transportation to provide the necessary evaluations in order to lower the speed limit on South Greenhaven Road to 35 miles per hour; and be it further RESOLVED, that the Town Clerk is hereby authorized to complete and submit the required TE-9 application to the Dutchess County Department of Public Works. Seconded Councilwoman Barbara Zulauf ROLL CALL VOTE: Dated: March 7, 2005 RESOLUTION 3:07:05 - 11 RE: Authorizing Yankee Stadium Trip Councilman Daniel French offers the following and moves its adoption: WHEREAS, the Recreation Department has organized a day trip on July 31, 2005 to Yankee Stadium for the enjoyment of our residents and has arranged for round-trip bus transportation; and WHEREAS, tickets for the baseball game will be available for purchase after June 1 at a cost of $51.00 per person; and WHEREAS, the cost of the bus, $695.00, has been included in the 2005 Recreation Budget; and WHEREAS, it is necessary to pay for the tickets in advance in order to reserve seats in the stadium as well as remit a deposit to the bus company; now therefore be it RESOLVED, that the Recreation Director is hereby authorized to enter into an agreement with Coach Tours for bus transportation as well the purchase of the tickets and to submit the required bus deposit of $200.00 as well as the balance per the attached contract and to purchase the 45 tickets at a cost of $2,295.00. RESOLUTION 3:07:05 - 12 RE: To Approve the Submission of an Application for the 2005 Greenway Conservancy Annual Grants Program Councilman Werner Stiegler offers the following and moves its adoption: WHEREAS, the Town of Beekman is applying to the Hudson River Valley Greenway for a grant under the 2005 Greenway Conservancy for the Hudson River Valley Annual Grant Program for a project entitled “Town Center Park Walk and Conservation Trail Project” to be located in the Town of Beekman; and WHEREAS, the grant application requires the applicant municipality to obtain the “approval/endorsement of the governing body of the municipality in which the project will be located”; now therefore be it RESOLVED, that the Town Board of the Town of Beekman hereby does approve and endorse the application for a grant under the 2005 Greenway Conservancy for the Hudson River Valley Annual Grant Program, for a project known as “Town Center Park Walk and Conservation Trail Project” located within this community.
