to - RESOLUTION 3:17:08 - 1 To Award Clean-Up Day Bids RESOLUTION 3:17:08 - 1 RE: To Award Clean-Up Day Bids Councilman Daniel French offers the following and moves its adoption: WHEREAS, Town clean-up day has been scheduled for Saturday April 26, 2008 and Saturday, October 25, 2008 between the hours of 8 a.m. to 2:30 p.m. in the Town Hall/highway parking lot; and WHEREAS, only one viable bid was received for services as described in the legal published notice and opened and read publicly by the Town Clerk on March 13, 2008; now therefore be it RESOLVED, that Royal Carting Service Co. be awarded the contract for both clean-up days as follows: Bulk Items $128.74 per ton And be it further RESOLVED, that the Supervisor be and hereby is authorized to execute any and all documents necessary to carry out the services. RESOLUTION 3:17:08 - 2 RE: 2008 Appointments Recreation Commission, Planning Board
WHEREAS, interviews have been conducted to fill the vacancies that exist; now therefore be it RESOLVED, that the Town Board hereby makes the following appointments to be effective immediately: Planning Board Davide Cabibbo Term to expire 12/31/08 Recreation Commission Eric Kanterman Term to expire 12/31/14
RESOLVED, that all appointees shall file their Oath of Office with the Town Clerk of the Town of Beekman prior to serving their term
RESOLUTION 3:17:08 - 3 RE: Appointment of Town Prosecutor Supervisor John Adams offers the following and moves its adoption: WHEREAS, the Town does not have the ability to prosecute zoning violations as well as certain traffic and vehicular violations in our local court; and WHEREAS, it will be in the best interest of the citizens of the Town of Beekman and economically prudent to implement a system for the enforcement and prosecution of said violations; and WHEREAS, a proposal for terms of employment as Town Prosecutor has been received from the Law Office of Michael O. Foley followed by an interview by the Town Board; now therefore be it RESOLVED, that the Town Board hereby accepts the proposal dated February 21, 2008 from Michael O. Foley to serve as the Town of Beekman Prosecutor at a fee of $500.00 for each monthly court session in which the various summonses will be prosecuted in addition to the terms and conditions outlined in the attached contract; and be it further RESOLVED, that the Supervisor is hereby authorized to execute a contract of employment between the Town of Beekman and Michael O. Foley once authorization has been granted by the Dutchess County District Attorney. Seconded Councilwoman Barbara Zulauf
RESOLUTION 3:17:08 - 4 RE: Appointing Independent Auditor For 2007 Audit - D’Arcangelo & Co., LLP Councilwoman Barbara Zulauf offers the following and moves its adoption: WHEREAS, the services of an independent auditor are required to audit the Town of Beekman’s financial records for the fiscal year ended December 31, 2007; and WHEREAS, prior audits by the town have been conducted by D’Arcangelo and Co., LLP; now therefore be it RESOLVED, that D’Arcangelo and Co., LLP, 120 Lomond Court, Utica New York, is hereby appointed to perform the year-end audit, as well as an audit of the records of the Town Judges, Town Clerk and Receiver of Taxes, at a fee not to exceed $27,000.00 and in accordance with D’Arcangelo’s March 7, 2008 Audit Proposal. RESOLUTION 3:17:08 - 5 RE: To Award Fencing Bid at Town Parks Councilman Thomas Kinsley offers the following and moves its adoption: WHEREAS, the Town Clerk was authorized to seek bids for fencing at the Senior League Field at Town Center Park and baseball batting cage at Recreation Park; and WHEREAS, the following bids were received, opened and read publicly on March 12, 2008:

RESOLUTION 3:17:08 - 6 RE: Authorizing Attendance at Workshop Highway Superintendent
WHEREAS, the Federal Highway Administration and the New York State Department of Transportation is sponsoring a workshop to assist in planning safer communities for bicyclists and pedestrians on June 19, 2008 in Saratoga County; and WHEREAS, the cost of $40.00 is included in the 2008 budget; now therefore be it RESOLVED, that Highway Superintendent, David Temple, is hereby authorized to attend the workshop.
RESOLUTION 3:17:08 - 7 RE: Authorizing Historian to Attend Conferences Councilman Werner Stiegler offers the following and moves its adoption: WHEREAS, the Association of Public Historians of New York State (APHNYS) will be holding their spring 2008 meeting of public historians on April 5, 2008 in Montgomery, New York, for which there is no charge; and WHEREAS, APHNYS will also be holding the 2008 Spring State Conference April 17-19, 2008 in Glens Falls, New York; and WHEREAS, the registration and lodging cost of $360.00 is included in the 2008 budget; now therefore be it RESOLVED, that Thom Usher, Town Historian, is hereby authorized to attend the above conferences.

RESOLUTION 3:17:08 - 8 RE: Authorizing the Supervisor to Sign, Submit and Implement Safe Routes to School Application Supervisor John Adams offers the following and moves its adoption: WHEREAS, the Town of Beekman is submitting a request for funds to the New York State Department of Transportation, pursuant to Section 1404 of the Safe Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) (Public Law 109-59) for a Safe Routes to School project for the programs stated purposes to enable and encourage school children in grades K – 8, including those with disabilities, to walk and bicycle to school; to make bicycling and walking to school a safer and more appealing transportation alternative, thereby encouraging a healthy and active lifestyle from an early age; and to facilitate the planning, development , and implementation of projects and activities that will improve safety and reduce traffic, fuel consumption, and air pollution in the vicinity of schools within two miles of the intersection of New York State Route 55 and County Route 9; and WHEREAS, the Town of Beekman and the State of New York will enter into a contract agreement which authorizes the undertaking of the Project and payment of the Federal Share; now therefore be it RESOLVED, that Supervisor John Adams is hereby authorized to act on behalf of the Town of Beekman to sign the application and progress and complete the above named project.

RESOLUTION 3:17:08 - 9 RE: Authorizing Entertainment for the Toddler & Tots End of Season Party Councilwoman Barbara Zulauf offers the following and moves its adoption: WHEREAS, the Recreation Department provides a Toddlers and Tots program during the school year; and WHEREAS, funds have been included in the 2008 budget for entertainment at their end of the season party on June 4, 2008; now therefore be it RESOLVED, that the payment of $595.00 for Pied Piper Pony Rides for this event is hereby authorized.
