Springs at Beekman Sewer Company, Inc.
RESOLUTION 5:15:06 - 1 RE: Authorizing Town Historian to
Attend Conference
Supervisor John Adams offers the following and moves its adoption:
WHEREAS, the 2006 Association of Public Historians of New York State (APHNYS)
Spring Conference will be held June 1 – June 3, 2006 at Columbia
University in Manhattan; and
WHEREAS, it will be beneficial for our Town Historian to attend said
conference; and
WHEREAS, the cost to attend the conference will be approximately $175.00
and is included in the 2006 budget; now therefore be it
RESOLVED, that the Town Historian, Thomas Usher, is hereby authorized
to attend the APHNYS Spring Conference.

RESOLUTION
5:15:06 - 2 RE: Insurance Renewal
Supervisor John Adams offers the following and moves its adoption:
WHEREAS, the insurance policy for the town is due to expire on May 20,
2006; and
WHEREAS, the Supervisor has obtained a proposal of insurance, which have
been reviewed by the Town Board; and
WHEREAS, it has been suggested that a second proposal be obtained; now
therefore be it
RESOLVED, that the Supervisor is hereby authorized to request the necessary
extension to the existing policy to allow for a second proposal to be
obtained; and let it be further
RESOLVED, that if an extension is not granted, that the Superivor is authorized
to accept the proposal from Selective Insurance Company as submitted by
Marshall & Sterling, Inc. and that the Supervisor be and hereby authorized
to execute the appropriate documents to implement the insurance proposal.

RESOLUTION
5:15:06 - 3 RE: Authorizing Attendance at “Responding to Emergencies”
Course
Councilwoman Barbara Zulauf offers the following and moves its adoption:
WHEREAS, the American Red Cross is offering a two-day course entitled
“Responding to Emergencies” on June 15 and 16, 2006; and
WHEREAS, such certification is required by the New York State Department
of Health for all day camps in New York State; and
WHEREAS, the cost of $180.00 is included in the 2006 budget; now therefore
be it
RESOLVED, that Natalie Thomas, the Assistant Day Camp Director, is hereby
authorized to attend the RTE Course.

RESOLUTION
5:15:06 - 4 RE: CONSENT OF TOWN OF BEEKMAN TOWN BOARD - Formation
of the Springs at Beekman Water Company, Inc.
Councilman Daniel French offers the following and moves its adoption:
WHEREAS, an application has been made to the Town of Beekman Town Board,
Dutchess County, New York for the incorporation of a water-works corporation
in the Town of Beekman, Dutchess County, New York pursuant to the Transportation
Corporations Law of the State of New York, and
WHEREAS, the Board having heard the application, and decided that it would
be advantageous to the Town and its inhabitants to grant this application,
it is hereby
RESOLVED, that such right, privilege and permission be and the same hereby
is granted by the Town of Beekman and accepted by the Superintendent of
Highways, upon the following terms, restrictions and conditions:
1. The Springs at Beekman Water Company, Inc. is hereby granted the
right and privilege to supply water to the residents and inhabitants
of the Springs at Beekman development and other potential outside users
in the Town of Beekman as set forth in the SEQRA Findings Statement
issued by the Planning Board on June 27, 2005; to lay and maintain pipes
and hydrants for delivering and distributing water; and to own, lease,
hold and maintain reservoirs, plants, lands, equipment, franchises and
appurtenances incidental to the supply of water.
2. All pipes shall be located under the direction of the Town Board
or its authorized agent.
3. At all times after the placing of pipes the corporation shall be
permitted to examine and to keep the same in proper condition and repair
and do all necessary work to maintain such installation.
4. All pipes shall be placed, erected and maintained in a workmanlike
manner so that they shall in no way endanger the public, and the corporation
shall at all times indemnify and save harmless the Town and the members
of the Town Board and the Superintendent of Highways from and against
any and all actions, suits, damages, costs, charges and expenses by
reason of the location and maintenance of the pipes or by reason of
any act done or omitted to be done by the corporation.
5. The corporation shall secure permission from such other public bodies,
officers and commissions as may be required by law.
6. The corporation shall enter into a memorandum of understanding ("MOU")
made by and between the corporation, the Town Board, and the Dutchess
County Water and Wastewater Authority which will provide the substantive
and procedural terms for the take over of the water system in case of
material and persistent defaults that remain uncured by the corporation,
as shall be more fully defined in the MOU.
7. The consideration hereof is the expenditure by the corporation of
the funds necessary for the construction of transmission lines and their
perpetual maintenance.

5:15:06 - 5 RE: CONSENT OF TOWN OF BEEKMAN TOWN BOARD - Formation

Councilman Werner Stiegler offers the following and moves its adoption:
WHEREAS, an application has been made to the Town of Beekman Town Board,
Dutchess County, New York for the incorporation of a sewer-works corporation
in the Town of Beekman, Dutchess County, New York pursuant to the Transportation
Corporations Law of the State of New York, and
WHEREAS, the Board having heard the application, and decided that it
would be advantageous to the Town and its inhabitants to grant this application,
it is hereby
RESOLVED, that such right, privilege and permission be and the same hereby
is granted by the Town of Beekman upon the following terms, restrictions
and conditions:
1. The Springs at Beekman Sewer Company, Inc. is hereby granted the
right and privilege to provide a sewer system for the residents and
inhabitants of the Springs at Beekman development and other potential
outside users in the Town of Beekman as set forth in the SEQRA Findings

2. All pipes shall be located under the direction of the Town Board
or its authorized agent.
3. At all times after the placing of sewer lines the corporation shall
be permitted to examine and to keep the same in proper condition and
repair and do all necessary work to maintain such installation.
4. All sewer lines shall be placed, erected and maintained in a workmanlike
manner so that they shall in no way endanger the public, and the corporation
shall at all times indemnify and save harmless the Town and the members
of the Town Board from and against any and all actions, suits, damages,
