RESOLUTION 06:16:03 - 1 RE: Authorizing Account Clerk to Attend Accounting Seminar Councilman Peter Barton offers the following and moves its adoption:

WHEREAS, the Office of the State Comptroller will be holding a course on Governmental Accounting September 23 through September 26 in Greenburgh, New York; and

WHEREAS, it will be beneficial for the Account Clerk to attend the seminar; and

WHEREAS, the cost of $85.00 is included in the 2003 budget; now therefore be it

RESOLVED, that the Town Board hereby authorizes Yvonne Rodrigues to attend the Governmental Accounting course.

RESOLUTION 06:16:03 - 2 RE: To Award Bid for Brush Control Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, the Town Clerk solicited bids for the Highway Department for brush control for the year 2003; and

WHEREAS, one bid was received, opened and read publicly at the office of the Town Clerk on June 6, 2003 at 2:00 p.m. and reviewed by the Highway Superintendent; now therefore be it

RESOLVED, that attached bid from B. Hubbard Ent. Inc. for brush control be hereby awarded.

RESOLUTION 06:16:03 - 3 RE: In Support of Collateral Source Bill Supervisor John Adams offers the following and moves its adoption:

WHEREAS, there is presently pending in Albany, the "Collateral Source Bill: Senate Bill s.222 and Assembly Bill A.3483; and

WHEREAS, said bill would amend the Civil Practice Law and Rules to eliminate the differences in the application of the collateral source rule between public and private defendants thereby closing the loophole that permits the collection of disability benefits for a work related injury and then collecting again in a personal injury lawsuit against the employer based on the same injury; and

WHEREAS, the Supervisor and the Town Board of the Town of Beekman wish to express their support of this bill; therefore be it

RESOLVED, that the Supervisor is hereby authorized to send a letter to Governor Pataki, Senator Vincent Leibell, Assemblyman Patrick Manning, Counsel to the Governor Richard M. Platkin, Sheldon Silver Speaker New York State Assembly, Joseph L. Bruno, Majority Leader New York State Senate expressing the support of the Town of Beekman for the "Collateral Source Bill".

RESOLUTION 06:16:03 - 4 RE: To Authorize Lease of Copier for Recreation Department Councilwoman Santospirito offers the following and moves its adoption:

WHEREAS, the lease contract on the Savin 9400D used by the Recreation Department has expired; and

WHEREAS, it is not to the Town's advantage to accept the buy-out option offered by IKON Capital of $1600.00; and

WHEREAS, three proposals for a new leased copier were sought; now therefore be it

RESOLVED, that the Town Board of the Town of Beekman hereby accepts the proposal submitted by Executive Copy Systems for a 39 month lease of a Mita CS1530 copier at $101.00 with a one dollar purchase option; and be it further

RESOLVED, that the Supervisor is authorized to sign a contract with Marlin Leasing once the Savin 9400D has been picked up by IKON Capital.

RESOLUTION 06:16:03 - 5 RE: Approval and Implementation of Employee Performance Evaluation Supervisor John Adams offers the following and moves its adoption:

WHEREAS, the Town Board of the Town of Beekman is desirous of implementing a formal procedure to conduct employee performance evaluations; and

WHEREAS, Section II, B and Section III, E of the Town of Beekman Personnel Manual approved on December 27, 2002 outlines the procedures for conducting annual performance evaluations as well as those employees subject to a six-month trial period; now therefore be it

RESOLVED, that the attached Employee Performance Evaluation is hereby approved; and be it further

RESOLVED, that department heads shall complete an annual evaluation for all employees under their supervision and submit said evaluation to the Town Supervisor by December 1 of each calendar year and for those subject to a six-month trial period no later than the completion of the fifth month of employment.

RESOLUTION 06:16:03 - 6 RE: Authorizing Entertainment for Summer Recreation Programs Supervisor John Adams offers the following and moves its adoption:

WHEREAS, the Recreation Department has planned entertainment to enhance their summer recreation programs; and

WHEREAS, funds for these programs have been allocated in the 2003 budget; now therefore be it

RESOLVED, that the Supervisor is hereby authorized to sign contracts for the following:

  • Mid-Hudson Children's Museum - Starlab Exhibit: $150.00
  • Beekman Country Club - Golf Instruction: $500.00

RESOLUTION 06:16:03 - 7 RE: To Erect a Barrier at Town Center Park Councilwoman Santospirito offers the following and moves its adoption:

WHEREAS, the proposed athletic field at the Town Center Park on Clove Valley Road is adjacent to freshwater wetlands and required a New York State Department of Environmental Conservation (NYSDEC) freshwater Wetlands Permit to install the necessary drainage system to protect the wetland resource; and

WHEREAS, said Permit requires the Town to erect a permanent barrier separating the athletic field complex and adjacent lawn from the wetlands area; and

WHEREAS, the cost for materials to erect said barrier is approximately $4,000.00 now therefore be it

RESOLVED, that the Town Board hereby authorizes that the funds for the purchase of fencing materials be made from the Special Recreation Fund (SRF) and not to exceed $4,000.00; and be it further

RESOLVED, that prior to the acquisition of materials, three written proposals will be sought in compliance with the Town's procurement policy.
