RESOLUTION 9:24:07 - 1 RE: To Award Dump Body for the Highway Department


Councilman Werner Stiegler offers the following and moves its adoption:


WHEREAS, the Town Clerk was authorized to seek bids for a new dump body to be mounted on the 1997 International highway truck; and

WHEREAS, the following bids were received, opened and read publicly on September 14, 2007

RESOLUTION 9:24:07 - 2 RE: Establishing Capital Project for The Open Space Initiative


Supervisor John Adams offers the following and moves its adoption:


WHEREAS, a bond resolution dated November 8, 2005 authorizing the acquisition of land, conservation easements, development rights and other purchases for the preservation of open space in and for the Town of Beekman at a maximum estimated cost of $3,000,000 and authorizing the issuance of $3,000,000 bonds was adopted by the Town Board; and

WHEREAS, the requisite mandatory referendum was duly held with no public input being received by the Town Clerk’s Office and subsequent Legal Notice of Estoppel being issued; and

WHEREAS, costs will be incurred associated with the negotiations and securing of grant monies for the purchase of development rights for the 305 acre McIntosh Farm on Route 216 and Frog Hollow Road through an agricultural conservation easement; and

WHEREAS, it is necessary to create a means to identify said costs and maintain an accounting of the costs associated with the purchase of development rights for the McIntosh Farm open space preservation; and

WHEREAS, Section 103 of Town Law allows for the creation of a “Capital Project” for any physical public betterment or improvement; now therefore be it

RESOLVED, that a “Capital Project” be hereby created to allow for the identification and financing, if necessary, of costs associated with the purchase of development rights for the McIntosh Farm.

RESOLUTION 9:24:07 - 3 RE: Authorizing Additional Trip for Senior Program


Supervisor John Adams offers the following and moves its adoption:

WHEREAS, funding is available in the 2007 Senior Program Budget for an additional bus trip; now therefore be it

RESOLVED, that payment for the charter of a bus to Madison Square Garden on November 29, 2007 for the Cirque de Soleil show in the amount of $1,075.00 is hereby authorized; and be it further

RESOLVED, that payment of the tickets, for which we will be reimbursed through ticket sales, to hold the reservation for said show in the amount of $1,915.00 as well as the dinner deposit of $100.00 is hereby authorized.

RESOLUTION 9:24:07 - 4 RE: Snowplowing Agreement Town of Beekman and Beekman Fire District


Councilwoman Barbara Zulauf offers the following and moves its adoption:

WHEREAS, Town Law Dec. 176 et seq. authorizes the commissioners of a fire district to enter into contracts governing the conduct of the fire protection services in which they engage; and

WHEREAS, the District is desirous of obtaining snowplowing and other services for its driveway, parking areas and accesses at its Firehouse; and

WHEREAS, accomplishing this in an efficient manner requires equipment impractical for the District to maintain in its own right and costly to hire; and

WHEREAS, the Town and its residents receive the benefit of the fire protection services provided by the District and the Town maintains snowplowing equipment of sufficient number and size to readily accommodate the District’s needs; further, the District participates and makes possible Town events by its presence in regulating traffic and controlling crowds when required; and

WHEREAS, as a taxing authority, if the District were not able to use the Town’s equipment it would have to lease the same elsewhere and the costs would be added to the District’s taxpayers; now therefore be it

RESOLVED, that the Town hereby enters into an agreement with the Commissioners of the Beekman Fire District to provide snowplowing services for the District’s driveway, parking areas and accesses at its Firehouse; and be it further

RESOLVED, that the Supervisor is hereby authorized to sign the attached Snowplowing Agreement.

RESOLUTION 9:24:07 - 5 RE: Authorizing the Highway Superintendent to Participate in the Dutchess County Sale of Surplus Vehicles & Equipment

Councilman Daniel French offers the following and moves its adoption:


WHEREAS, Dutchess County is conducting a sale of surplus vehicles and equipment on October 25, 2007 and are inviting local municipalities to participate; and

WHEREAS, Town Law Sec. 64(2-a) and Highway Law Sec. 142(5) permit the Superintendent of Highways, with the approval of the Town Board, to sell vehicles or machinery which are worn, obsolete or no longer needed by the Town; and

WHEREAS, the Superintendent of Highways has determined that the following items of Town property are no longer needed and should be sold, to wit:

1993 Chevrolet 1 Ton Dump, # 1GBJK34F9PE198495
with plow and 2 yard Torwel sander
1970 Ford Fire Truck, #F90LJ20748

Now therefore be it RESOLVED, that the Town Board approves the determination of the Superintendent of Highways to dispose of the above items of Town property; and that the Superintendent is authorized to participate in the surplus sale of vehicles and equipment Dutchess County is holding on October 25, 2007.

RESOLUTION 9:24:07 - 6 RE: Verifying 2006 Audit Completed

Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, Town Law Section 123 requires a yearly examination, or audit by the Town Comptroller, of the books and records of certain departments which maintain financial accounts in the Town of Beekman name; and

WHEREAS, the Comptroller was authorized to conduct said internal audit of these books and records for the fiscal year 2006; now therefore be it

RESOLVED, that the Town Board hereby acknowledges that the Comptroller has completed the internal audit of the books and records of the Town Clerk, Receiver of Taxes, Justice Court and Building Department for the fiscal year 2006; and be it further

RESOLVED, that said audit has found the books and records of these departments to be in order.
