RESOLUTION 10:03:05 - 1 RE: For Notice of Public Hearing on Preliminary Budget

Councilman Thomas Kinsley offers the following and moves its adoption:


NOW BE IT RESOLVED, that pursuant to Sect. 108 of New York State Law, a public hearing on the 2006 preliminary budget shall be held on the 7th day of November, 2005 at 7:20 PM at the Town Hall, 4 Main Street, Poughquag, in the Town of Beekman, New York; and be it further

RESOLVED, that notice stating the time and place of such hearing the purpose thereof, that copy of the preliminary budget is available at the office of the Town Clerk after October 17, 2005, and all other requirements of Town Law Sect. 108, shall be published in the Poughkeepsie Journal, a newspaper circulating in the Town of Beekman, and posted on the signboard of the Town on or before the 27th day of October, 2005.

RESOLUTION 10:03:05 - 2 RE: To Set Hearing on Pawling Lake Assessment Roll

Councilwoman Barbara Zulauf offers the following and moves its adoption:

WHEREAS, the Assessor to the Town of Beekman has completed and filed the assessment roll for the Pawling Lake Estates Road Improvement District pursuant to Article 15 of the New York State Town Law; now therefore be it

RESOLVED, that pursuant to §239 of the Town Law a public hearing on such assessment roll shall be held on the 7th day of November, 2005 at 7:10 o’clock p.m. at the Town Hall, 4 Main Street, Poughquag, in the Town of Beekman, New York; and be it further

RESOLVED, that notice shall be published in the Poughkeepsie Journal on or before the 27th day of October, 2005 stating that the Pawling Lake Estates Road Improvement District Assessment Roll has been completed and that the Town Board will meet and hear any objections which may be made to the roll at the time and place as specified above, and that such notice shall also be posted on the signboard of the Town on or before the 27th day of October, 2005.

Councilman Daniel French offers the following and moves its adoption:

WHEREAS, an action entitled Jeffrey Higham vs. The Town of Beekman, New York, The Town Board of the Town of Beekman, N.Y., David Temple, Werner Stiegler, Daniel French, Thomas Kinsley, Barbara Zulauf, and John D. Adams has been filed in the Supreme Court of the State of New York County of Dutchess as Case No. 05/4600; and

WHEREAS, an action entitled Jeffrey Higham vs. the Town of Beekman, New York, The Town Board of the Town of Beekman, N.Y., David Temple, Werner Stiegler, Daniel French, Thomas Kinsley, Barbara Zulauf, and John D. Adams has been filed in the United States District Court, Southern District of New York as Case No. 05 CIV 7979; now therefore be it

RESOLVED, that pursuant to Section 11-2 of the Town Code of the Town of Beekman, Lance Klein, Attorney at Law, of the firm Keane and Beane P.C., be and hereby retained to represent Defendants Town Supervisor John Adams, Town Board Members Stiegler, French, Kinsley and Zulauf, and Highway Superintendent David Temple and the Town of Beekman in the above-mentioned actions.

RESOLUTION 10:03:05 - 4 RE: Appointing Surveyor for “Community Walkaway” Project

Councilman Werner Stiegler offers the following and moves its adoption:


WHEREAS, by previous resolution on July 11, 2005, the Town Board authorized the expenditure of Special Recreation Funds (SRF) to be utilized for the development of the “Community Walkway” project; and

WHEREAS, the amount of funds approved included the cost of a survey needed in order to proceed with the second phase of the project to be developed from the entrance of Recreation Center Road to the corner of Beekman-Poughquag Road; now therefore be it

RESOLVED, that the Town Board hereby appoints Link Land Surveyors to survey and stake the Town’s right-of-way on Recreation Road from Recreation Center Road to the corner of Beekman-Poughquag Road at a cost not to exceed $5,000.00
