RESOLUTION 10:15:07 - 1 RE: For Notice of Public Hearing on 2008 Preliminary Budget

Supervisor John Adams offers the following and moves its adoption:

NOW BE IT RESOLVED, that pursuant to Sect. 108 of New York State Law, a public hearing on the 2008 preliminary budget shall be held on the 5th day of November, 2007 at 7:10 PM at the Town Hall, 4 Main Street, Poughquag, in the Town of Beekman, New York; and be it further

RESOLVED, that notice stating the time and place of such hearing, the purpose thereof, that copy of the preliminary budget is available at the office of the Town Clerk after October 15, 2007, and all other requirements of Town Law Sect. 108, shall be published in the Poughkeepsie Journal, a newspaper circulating in the Town of Beekman, and posted on the signboard of the Town on or before the 25th day of October, 2007.

RESOLUTION 10:15:07 - 2 RE: Applying for a Certificate of Need for Ambulance Operation

Supervisor John Adams offers the following and moves its adoption:


WHEREAS, the Town of Beekman is cognizant of the fact that the Beekman Fire Department is unable, due to lack of available volunteers, to provide a volunteer Ambulance Service for the Town of Beekman; and

WHEREAS, based upon the unavailability of a volunteer ambulance service to cover the Town of Beekman; the Town has researched the process required in order to contract for the operation of an EMS service; and

WHEREAS, the Town Board of the Town of Beekman has reviewed the different options available for the provision of ambulance service to the Town of Beekman; and

WHEREAS the Town Board of the Town of Beekman has determined that it would be in the best interest of the Town of Beekman to contract for ambulance service covering the entire Town of Beekman, effective as of January 1, 2008; now therefore be it

RESOLVED, that the Town Board of the Town of Beekman hereby authorizes the Supervisor and the Town Attorney to take all appropriate steps required in order to obtain any and all approvals of permits and certificates necessary for the Town of Beekman to establish and operate an ambulance service pursuant to §3008(7)(a) of the N.Y.S. Public Health Law, covering the entire Town of Beekman to be effective January 1, 2008.

RESOLUTION 10:15:07 - 3 RE: Authorizing the Town Historian to Attend Conference

Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, the Association of Public Historians of New York State (APHNYS) is hosting the 2007 Fall Conference in Hunter, New York on October 22 to October 24, 2007; and

WHEREAS, the cost for the Town Historian to attend is approximately $400.00 for registration, food and lodging; and

WHEREAS, attendance at conferences is included in the 2007 budget; now therefore be it

RESOLVED, that the Town Historian, Thom Usher, is hereby authorized to attend the APHNYS conference.

RESOLUTION 10:15:07 - 4 RE: To Set Hearing on Dover Ridge Sewer District Assessment Roll

Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, the Assessor to the Town of Beekman has completed and filed the assessment roll for the Dover Ridge Sewer District pursuant to Article 15 of the New York State Town Law; now therefore be it

RESOLVED, that pursuant to §239 of the Town Law a public hearing on such assessment roll shall be held on the 5th day of November, 2007 at 7:00 o’clock p.m. at the Town Hall, 4 Main Street, Poughquag, in the Town of Beekman, New York; and be it further

RESOLVED, that notice shall be published in the Poughkeepsie Journal on or before the 25th day of October, 2007 stating that the Dover Ridge Sewer District Assessment Roll has been completed and that the Town Board will meet and hear any objections which may be made to the roll at the time and place as specified above, and that such notice shall be posted on the signboard of the Town on or before the 25th day of October, 2007.

RESOLUTION 10:15:07 - 5 RE: Authorizing Entertainment for Fall Festival and Senior Hoe Down


Councilwoman Barbara Zulauf offers the following and moves its adoption:


WHEREAS, the annual Fall Festival sponsored by the Recreation Department will be held on October 21, 2007; and

WHEREAS, the Senior Hoe Down for the Senior Citizen Program will be held on November 15, 2007; and

WHEREAS, funds for entertainment at the Fall Festival and the Senior Program were included in the 2007 budget; now therefore be it

RESOLVED, that the Supervisor is hereby authorized to enter into contracts with the following vendors for the 2007 Fall Festival:

 

Stolen Heart Band $ 600.00
Tom Swetz Magic Show $ 175.00
Two by Two Express $ 650.00
Southwest Inflatables $ 900.00

And be it further RESOLVED, that the Supervisor is hereby authorized to enter into a contract with the following vendor for the Senior Hoe Down:

RESOLUTION 10:15:07 - 6 RE: Authorizing Prepayment of Fireworks Display For Community Day 2008

Councilman Thomas Kinsley offers the following and moves its adoption:

WHEREAS, the 2008 Annual Community Day is scheduled for July 19, 2008; and

WHEREAS, it has been a tradition to have a fireworks display for the enjoyment of our community; and

WHEREAS, payment in full by November 15, 2007 for a 2008 display will entitle the Town to a “Mid Show Barrage” or 100 additional finale shells; now therefore be it

RESOLVED, that the Supervisor is hereby authorized to enter into a contract for the 2008 fireworks display to be provided by Bay Fireworks at a cost of $3,500.00 and to prepay this amount by November 15, 2007.

RESOLUTION 10:15:07 - 8 RE: Authorizing Attendance at Stormwater Conference

Councilman Thomas Kinsley offers the following and moves its adoption:


WHEREAS, the Lower Hudson Coalition of Conservation Districts is holding the 7th Annual Southeast New York Stormwater Conference and Trade Show on October 17, 2007 in Beacon, New York; and

WHEREAS, municipalities are mandated to comply with stormwater regulations and requirements set forth by the New York State Department of Environmental Conservation, therefore, attendance at this conference will be beneficial to the Town; and

WHEREAS, the cost of $75.00 is included in the 2007 budget for attendance at conferences; now therefore be it

RESOLVED, that Zoning Board of Appeals member, Peter Puleo, and the Town Planning Consultant, Curt Lavalla, are herby authorized to attend said Stormwater Conference.

RESOLUTION 10:15:07 - 9 RE: To Set Public Hearing on a Local Law Imposing a Town Wide Moratorium

Councilwoman Barbara Zulauf offers the following and moves its adoption:

WHEREAS, the Town Board of the Town of Beekman desires to enact a town-wide moratorium to temporarily suspend land development in the Town of Beekman for an interim period of time pending completion and adoption of amendments to the Town of Beekman’s land use regulations to be brought in accordance with the Town’s revised Comprehensive Plan; now therefore be it

RESOLVED, that a public hearing on the proposed Local Law imposing a town-wide moratorium shall be held on the 5th day of November, 2007 at 7:20 o’clock p.m. at the Town Hall, 4 Main Street, Poughquag, New York; and be it further

RESOLVED, that notice stating the time and place of such hearing and the purpose thereof, shall be published in the Poughkeepsie Journal, a newspaper circulating in the Town of Beekman, and posted on the signboard of the Town on or before the 25th day of October, 2007; and be it further

RESOLVED, that a copy of the proposed Local Law will be available in the Town Clerk’s office after October 17, 2007.

RESOLUTION 10:15:07 - 10 RE: To Release Bond for Turkey Run Road in the DiCostanza Subdivision

Councilman Daniel French offers the following and moves its adoption:

WHEREAS, the road known as Turkey Run Road was accepted as a Town highway on June 5, 2006; and

WHEREAS, there remains a bond in the amount of $5,550.00 which was retained as a maintenance bond as an assurance against defect or failure of said road and with the stipulation that the Highway Superintendent and the Town Engineer shall inspect the road for damages that may occur over the winter of 2006-2007; and

WHEREAS, the Highway Superintendent and the Town Engineer did inspect the road and have not found any deterioration to any part of Turkey Run Road over the course of this past winter and recommend that the maintenance bond be returned to the applicant; now therefore be it

RESOLVED, that the Town Board hereby approves the return of the bond in the amount of $5,550.00 to the applicant.
