RESOLUTION 11:6:06 - 1 RE: To Affirm and Adopt Assessment Roll for 2007 For Capital Improvements Made to the Dover Ridge Sewer District

Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, the Assessor to the Town of Beekman completed and filed the assessment-roll for the Dover Ridge Sewer District pursuant to Article 15 of the New York State Town Law; and

WHEREAS, the Town Board caused due notice of the completion of the assessment-roll and of the time and place wherein the Town Board would meet and hear and consider any objections to the roll to be duly published according to law; and

WHEREAS, the Town Board did meet at the Town Hall, 4 Main Street, Poughquag in the Town of Beekman, New York, at the time and place specified in the notice, and heard and considered all objections to said assessment-roll; now therefore be it

RESOLVED, that the Dover Ridge Sewer District assessment-roll be and is hereby affirmed and adopted as originally proposed and filed in the office of the Town Clerk of the Town of Beekman; and be it further

RESOLVED, that the Supervisor be and hereby is directed to transmit a copy of said assessment roll to the Board of Legislators of the County to be levied and assessed upon the lots and parcels of lands listed in said assessment roll at the time and in the manner provided by law for the levy of State, County and Town taxes.

WHEREAS, the Assessor to the Town of Beekman completed and filed the assessment-roll for the Pawling Lake Estates Road Improvement District pursuant to Article 15 of the New York State Town Law; and

WHEREAS, the Town Board caused due notice of the completion of the assessment-roll and of the time and place wherein the Town Board would meet and hear and consider any objections to the roll to be duly published according to law; and

WHEREAS, the Town Board did meet at the Town Hall, 4 Main Street, Poughquag in the Town of Beekman, New York, at the time and place specified in the notice, and heard and considered all objections to said assessment-roll; now therefore be it

WHEREAS, The Mid-Hudson Valley Chapter New York State Building Officials Conference and International Codes Council is sponsoring a two day education seminar on residential plan review in Poughkeepsie on November 8 and 9, 2006; and

WHEREAS, the cost of $180.00 is included in the 2006 budget; now therefore be it

RESOLVED, that the Town of Beekman Building Inspector, Thomas McHugh, is hereby authorized to attend said seminar.

RESOLUTION 11:6:06 - 4 Supervisor John Adams offers the following and moves its adoption:

BE IT RESOLVED, that the Town Board of the Town of Beekman hereby approves the settlement of the federal action encaptioned Higham v. Temple, et al., 05 Civ. 7979 (WCC), and the related state proceeding encaptioned In re Higham v. Town of Beekman, et al., Appellate Division Docket No. 2006-2025; and

BE IT FURTHER RESOLVED, that the Town Supervisor and Town Board for the Town of Beekman, Keane & Beane, P.C., are hereby authorized to execute all necessary documents in furtherance of such settlement and to act in compliance with this Resolution.

RESOLUTION 11:6:06 - 5 RE: To Request NYS DOT to Restrict “Through Commercial” Traffic on Recreation Road


Councilman Thomas Kinsley offers the following and moves its adoption:

WHEREAS, commercial vehicles have been using Recreation Road in the Town of Beekman as an alternative route to get to either County Route 7 or NY State Route 55; and

WHEREAS, the narrowness of Recreation Road causes a concern as a public walking trail was constructed along Recreation Road to provide the community with a safe, healthy and enjoyable walking environment; and

WHEREAS, Recreation Road is not designed to sustain the excessive volume of these heavy vehicles; and

WHEREAS, the Town Board recommends posting a sign that restricts commercial traffic from Recreation Road to ensure the safety and well being of our community as well as maintenance of our roadways; now therefore be it

RESOLVED, that the Town Board hereby requests the New York State Department of Transportation to provide the necessary evaluations in order to restrict “through commercial” traffic from Recreation Road; and be it further

RESOLVED, that the Town Clerk is hereby authorized to complete and submit the required TE-9 application to the Dutchess County Department of Public Works.

RESOLUTION 11:6:06 - 6 LOCAL LAW # _______ OF 2006 Of the Town of Beekman


A LOCAL LAW PROHIBITING THE SOLICITATION OF TOWING BUSINESS AT MOTOR VEHICLE ACCIDENTS


Authority

This article is adopted pursuant to the authority of Town Law Section 130(7).

Purpose/Findings

The Town Board of the Town of Beekman hereby makes the following findings. The health, safety and welfare is adversely affected by the practice of some tow truck operators in the Town of Beekman coming to the scene of motor vehicle accidents in order to solicit business from those involved in the accident. The arrival at the scene of more tow trucks than area required, unnecessarily expands the scene of the accident to include those tow trucks. This increases traffic congestion and creates greater difficulty in directing traffic around the scene. Increased traffic congestion can cause delay for emergency vehicles and possibly life-saving personnel and equipment in arriving at the scene of the accident and at other emergencies that may occur at the same time. Also, this increased congestion can cause other motor vehicle accidents to occur and thus unnecessarily increase the risk of injury to emergency personnel, persons and property. The presence of more tow trucks than are required can also interfere with the activities of those police officers investigating the causes of the accident.

Prohibited Act

The solicitation of towing business at motor vehicle accidents prohibited within the Town of Beekman.

It shall be unlawful for any person operating a tow truck to cause the said tow truck to remain within 1,000 feet of the scene of a motor vehicle accident unless such person has been called to the scene by a police officer or by a person involved in the mishap.

Penalties for Offenses

A violation of this section shall be punishable by a fine of not less than $ 500 for the first offence and by a fine of not less than $1,000 for a second or subsequent offence within one-year of the previous offense.

RESOLUTION 11:6:06 - 7 RE: To Set Public Hearing for Local Law Prohibiting the Solicitation of Towing Business at Motor Vehicle Accidents

Councilman Daniel French offers the following and moves its adoption:

WHEREAS, the Town Board of the Town of Beekman wishes to enact a local law prohibiting the solicitation of towing business at motor vehicle accidents within the Town of Beekman due to the adverse effects caused by such pursuits; now therefore be it

RESOLVED, that a public hearing on said local law will be held on the 20th day of November, 2006 at 7:20 o’clock p.m. at the Town Hall, 4 Main Street, Poughquag, in the Town of Beekman, New York; and be it further

RESOLVED, that notice stating the time and place of such hearing and setting forth the proposed local law, or describing in general terms the proposed amendment, shall be published on or before the 10th day of November, 2006 in the Poughkeepsie Journal, a newspaper circulating in the Town of Beekman, and posted on the signboard of the Town.

RESOLUTION 11:6:06 - 8 RE: To Request NYS DOT to Authorize a Traffic Light at the Intersection of County Route 7 & Beekman Road (County Route 9)


Supervisor John Adams offers the following and moves its adoption:

WHEREAS, the Town of Beekman and the surrounding towns have seen a great and rapid escalation of growth resulting in an increased volume of traffic on our roads; and

WHEREAS, this increased volume of traffic has resulted in numerous traffic accidents at key intersections on heavily traveled roads in the Town of Beekman; and

WHEREAS, in the best interest of the well being and safety of our citizens, the Town Board has determined that a traffic light at the intersection of County Route 7 and Beekman Road (County Route 9) would aid in reducing the number of potential accidents and at the same time provide relief in the amount congestion of vehicles on County Route 7 attempting to turn onto Beekman Road; now therefore be it

RESOLVED, that the Town Board hereby requests the New York State Department of Transportation to provide the necessary evaluations in order to place a traffic light at the intersection of Beekman Road (County Route 9) and County Route 7; and be it further

RESOLVED, that the Town Clerk is hereby authorized to complete and submit the required TE-9 application to the Dutchess County Department of Public Works.

RESOLUTION 11:6:06 - 9 RE: To Request NYS DOT to Authorize a Yield Sign on Main Street (County Route 7) (At the Access Intersection onto Main Street from West NYS Route 216)


Councilwoman Barbara Zulauf offers the following and moves its adoption:

WHEREAS, accidents are occurring between vehicles traveling on NYS Route 216 westbound from NYS Route 55 turning onto Main Street (County Route 7) with the vehicles traveling eastbound on NYS Route 216 also turning onto Main Street (County Route 7) due to the confusion of who has the right of way; and

WHEREAS, to address this problem and prevent further accidents, the Town Board of the Town of Beekman recommends placing a yield sign on Main Street (County Route 7) at the intersection of access onto Main Street from West NYS Route 216; now therefore be it

RESOLVED, that the Town Board hereby requests the New York State Department of Transportation to provide the necessary evaluations in order to place a yield sign at said intersection; now therefore be it further

RESOLVED, that the Town Clerk is hereby authorized to complete and submit the required TE-9 application to the Dutchess County Department of Public Works.
