RESOLUTION 11:7:05 - 1 RE: Appointing Special Planning Consultant for Beekman Meadows Project


Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, Prestige Development, LLC has made application for the construction of 120 townhouse units with a clubhouse, swimming pool and tennis/athletic court at the intersection of Church Street and Route 55 to be named Beekman Meadows; and

WHEREAS, the Town of Beekman Planning Board recommends that it is in the best interest of the Town and the above applicant to use a planning consultant to assist the Planning Board in the performance of a coordinated SEQRA review; now therefore be it

RESOLVED, that Mr. Arthur Brod of Planners East, Inc., who also advises the Planning Board on other projects in the Town, be and hereby is appointed as the Planning Board SEQRA consultant for the Beekman Meadows Project; and be it further

RESOLVED, that Mr. Brod’s professional fees will be paid from the developer’s escrow account established for this project.

RESOLUTION 11:7:05 - 2 RE: Naming of “Danielles Way”

Councilman Daniel French offers the following and moves its adoption:

WHEREAS, Dutchess County Enhanced 911 Department of Emergency Response has received a request for a new private drive name for three parcels off Route 216 in the Maple Farms Estates Subdivision; and

WHEREAS, 911 Addressing Office has reviewed the proposed name of “Danielles Way” and finds it meets their 911 criteria for naming streets; and

WHEREAS, both the Planning Board and the Beekman Fire District approve of the proposed name; now therefore be it

RESOLVED, that the name “Danielles Way” is hereby approved for the private drive intersecting with Route 216 in the Maple Farms Estate Subdivision; and be it further

RESOLVED, that Dutchess County Emergency Response be duly notified so that this road may be placed in the 911 database.

RESOLUTION 11:7:05 - 3 RE: Pursuant to 2NYCRR Chapter III, Part 85.3


Councilman Thomas Kinsley offers the following and moves its adoption:


WHEREAS, the Town Board of the Town of Beekman did previously authorize an increase in the maximum cost of the improvements to the Dover Ridge Sewer District to $1,200,000.00; and

WHEREAS, said authorization was subject to referendum by petition and;

WHEREAS, the period for said petition has expired without the filing of a petition; and

WHEREAS, said increase requires the approval of the Office of the New York State Comptroller; and

WHEREAS, a supplemental application for approval of this further increase has been prepared by the Attorney to the Town and executed on the Town’s behalf by the Town Supervisor; now therefore be it

RESOLVED, that the Town Board of the Town of Beekman ratifies said application and declares the following findings pursuant to NYCRR 85.3 of Chapter III:

  1. That the supplemental application for the Comptroller’s approval was prepared at the Board’s direction and it believes its contents to be accurate;
  2. That the Board has determined that the increased expenditure for which permission is sought is in the public interest and will not constitute an undue burden on the properties bearing the cost thereof;
  3. That the cost of the proposed expenditure is to be assessed wholly against the property in the district benefited; that all real property so assessed will be benefited by the expenditure and that no benefited property has been excluded.

RESOLUTION 11:7:05 - 4 RE: To Affirm and Adopt Assessment Roll for 2006 For Capital Improvements Made to the Dover Ridge Sewer District


Councilwoman Barbara Zulauf offers the following and moves its adoption:

WHEREAS, the Assessor to the Town of Beekman completed and filed the assessment-roll for the Dover Ridge Sewer District pursuant to Article 15 of the New York State Town Law; and

WHEREAS, the Town Board caused due notice of the completion of the assessment-roll and of the time and place wherein the Town Board would meet and hear and consider any objections to the roll to be duly published according to law; and

WHEREAS, the Town Board did meet at the Town Hall, 4 Main Street, Poughquag in the Town of Beekman, New York, at the time and place specified in the notice, and heard and considered all objections to said assessment-roll; now therefore be it

RESOLVED, that the Dover Ridge Sewer District assessment-roll be and is hereby affirmed and adopted as originally proposed and filed in the office of the Town Clerk of the Town of Beekman; and be it further

RESOLVED, that said assessment roll be and the same hereby is filed in the office of the Town Clerk and the Supervisor be and hereby is directed to transmit a copy of said assessment roll to the Board of Legislators of the County to be levied and assessed upon the lots and parcels of lands listed in said assessment roll at the time and in the manner provided by law for the levy of State, County and Town taxes.

RESOLUTION 11:7:05 - 5 RE: Authorizing Attendance at Recreation Conference

Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, the New York State Recreation and Parks Service will be holding their annual Downstate Conference on November 16, 2005 in White Plains; and

WHEREAS, the workshops scheduled throughout the day will be beneficial to our Recreation Department; and

WHEREAS, funds for training and conferences have been included in the 2005 recreation budget; now therefore be it

RESOLVED, that Sandy Washburn and Chris Gates be hereby authorized to attend the Downstate Conference.

RESOLUTION 11:7:05 - 6 RE: Authorizing Music for Thanksgiving Party For Senior Citizen Program

Councilman Daniel French offers the following and moves its adoption:

WHEREAS, the Recreation Department has planned a Thanksgiving Party for the Senior Citizen Program on November 17, 2005 to include live music; and

WHEREAS, the cost for the band Stolen Hearts is $600.00; and

WHEREAS, funds for this event are included in the 2005 Recreation budget; now therefore be it

RESOLVED, that the Town Board hereby authorizes payment of $600.00 to Stolen Hearts for music at the Senior Thanksgiving Party on November 17, 2005.
