Auction of Excess Highway Equipment RESOLUTION 12:02:02 - 1 RE: Authorizing Auction of Excess Highway Equipment Supervisor John Adams offers the following and moves its adoption: WHEREAS, the Superintendent of Highways has advised the Town Board of the existence of a number of pieces of equipment and machinery which are obsolete or otherwise of no use; and WHEREAS, most of these pieces were designed to fit vehicles no longer in the Town's inventory; and WHEREAS, Town Law Sec. 64(2A) authorizes town boards to sell and dispose of unneeded town property; now therefore be it RESOLVED, that the following articles of equipment are determined to be of no use or value to the Town: (1) Truck
Craft pickup slide-in dump body and be it further RESOLVED, that the Supervisor and Superintendent of Highways are hereby authorized and directed to deliver these articles to the following auctioneer: Davis Auction Company for the purpose of sale and for the auctioneer to retain from the purchase price the reasonable cost of sale. CALL VOTE: Dated: December 2, 2002 RESOLUTION 12:02:02 - 2 RE: Authorization to Increase Dover Ridge Water and Sewer Rates Councilman Werner Stiegler offers the following and moves its adoption: WHEREAS, the Dover Ridge Water and Sewer Districts operate within the Town of Beekman; and WHEREAS, the Town of Beekman has been subsequently authorized to send invoices to all landowners of Dover Ridge Estates in the amount of $90.00 per quarter for sewer service and the minimum tariff amount of $34.92 for water usage; and WHEREAS, these amounts provide insufficient revenue to cover the ongoing operation and maintenance costs of the District; and WHEREAS, pursuant to Article 14-F of the General Municipal Law, a public hearing for the proposed increase of water and sewer rents was duly held on the 14th day of November, 2002; now therefore let it be RESOLVED, that effective January 1, 2003, quarterly invoices sent to all landowners of Dover Ridge Estates for water usage and sewer service will reflect the following rates: Water

CALL VOTE: Dated: December 2, 2002 RESOLUTION 12:02:02 - 3 RE: Lifting of Water Restrictions Councilwoman Santospirito offers the following and moves its adoption: WHEREAS, on September 9, 2002 the Town Board asked the residents of the Town of Beekman to be diligent in their efforts to conserve water due to drought advisories by not watering lawns, washing cars or filling swimming pools from town or well water; and WHEREAS, recent precipitation has replenished the water supplies, now therefore let it be RESOLVED, that these restrictions are hereby lifted. CALL VOTE: Dated: December 2, 2002 RESOLUTION 12:02:02 - 4 RE: Naming of "Moran Way" Councilman Peter Barton offers the following and moves its adoption: WHEREAS, Dutchess County Enhanced 911 Department of Emergency Response has received a request for a new private drive name in a six parcel subdivision off Sylvan Lake Road; and WHEREAS, the 911 Addressing Office has reviewed the proposed name of "Moran Way" and finds it meets their 911 criteria for naming streets; now therefore be it RESOLVED, that the name "Moran Way" is hereby approved for the private drive located between "Friendly Way and the entrance to the "View Hill Co-op property; and be it further RESOLVED, that Dutchess County Emergency Response will by duly notified so that this road may be placed in the 911 database. CALL VOTE: Dated: December 2, 2002 RESOLUTION 12:02:02 - 5 RE: Local Law No. ___ of 2002 Increase Levels for Persons with Disabilities and Limited Incomes. A LOCAL LAW TO AMEND the CODE OF THE TOWN OF BEEKMAN by amending Chapter 135, Article III to increase the income eligibility level for a partial exemption for the taxation of real property owned by persons with disabilities and limited incomes by $1,000 in each exemption category. Supervisor John Adams offers the following and moves its adoption: WHEREAS, Chapter 198 of the Laws of 2002 increased eligibility ceilings by $1,000 for Persons with Disabilities and Limited Incomes Tax Exemption pursuant to §467 of the New York State Property Tax Law, which authorizes any municipal corporation pursuant to local law, ordinance or resolution to set the income eligibility level for a partial exemption from the taxation of real property owned by persons with disabilities and limited income; and WHEREAS, the Town of Beekman Assessor's Office recommends that increasing the income eligibility level to the maximum permitted under the Real Property Tax Law would have a minor impact on the taxable real property tax base of the Town of Beekman, now therefore, having complied with the provisions of Section 130 of the Town Law, BE IT ENACTED by the Town Board of the Town of Beekman, County of Dutchess, State of New York, that §135-4 of Chapter 135, Article III of the Code of the Town of Beekman be and hereby is amended to increase the income eligibility level for a partial exemption for the taxation of real property owned by persons with disabilities and limited incomes by $1,000 in each exemption category, so as to read as set forth on the attached schedule. A LOCAL LAW TO AMEND the CODE OF THE TOWN OF BEEKMAN by amending Chapter 135, Article III to increase the income eligibility level for a partial exemption for the taxation of real property owned by senior citizens by $1,000 in each exemption category.
