RESOLUTION 12:5:05 - 1 RE: Authorizing Professional Services for Grant Submission for Open Space Preservation Projects

Councilman Werner Stiegler offers the following and moves its adoption:


WHEREAS, the Town adopted an Open Space Plan on April 4, 2005 in order to protect the town’s scenic open space resources so vital to the preservation of Beekman’s unique character; and

WHEREAS, the Town Board is ready to proceed with up to two projects for farmland protection grant funding to advance the goals established in the town’s Open Space Plan; and

WHEREAS, one land owner has already signed a Letter of Intent to move forward with the purchase of development rights and placement of an agricultural conservation easement; and

WHEREAS, Behan Planning Associates, LLC has submitted a proposal to provide professional services to the town to assist with said farmland protection projects including the grant application process; now therefore be it

RESOLVED, that the Town Board hereby accepts the proposal from Behan Planning, herewith attached, at a cost not to exceed $9,000.00; and be it further

RESOLVED, that the Supervisor is hereby authorized to sign a contract with Behan Associates accepting their services as outlined on the attached proposal.

RESOLUTION 12:5:05 - 2 RE: To Create Capital Project within the Capital Project Funds for the Dover Ridge Inflow & Infiltration Remediation


Councilman Thomas Kinsley offers the following and moves its adoption:


WHEREAS, the Town manages the Dover Ridge Sewer District located in the Town of Beekman; and

WHEREAS, reports compiled by Aquarion Services Company, who operates and maintains said sewer district, demonstrate that during periods of heavy rainfall, the discharge amounts created by the Dover Ridge Sewer System exceed the limits permitted by the Department of Environmental Conservation; and

WHEREAS, the consulting engineer providing services for the Dover Ridge water and wastewater treatment plant rehabilitation, Insite Engineering, has been actively investigating and recommending corrective measures relating to this “inflow and infiltration” problem; and

WHEREAS, it is necessary to create a means to identify the costs and maintain an accounting of the costs associated with Insite’s study and corrective action so that they can be charged to the residents residing in the Dover Ridge Sewer District; and

WHEREAS, Section 103 of Town Law allows for the creation of a “Capital Project” for any physical public betterment or improvement; now therefore be it

RESOLVED, that a “Capital Project” be hereby created to allow for the identification and financing, if necessary, of costs associated with the inflow and infiltration of the Dover Ridge Sewer System; and be it further

RESOLVED, that these costs shall be charged to the users of the Dover Ridge Sewer System.

RESOLUTION 12:5:05 - 3 RE: To Seek Proposals for 2006 Highway Materials


Supervisor John Adams offers the following and moves its adoption:


WHEREAS, the Highway Superintendent has requested that the Town Board authorize the Department to seek bids for highway materials for the year 2006; now therefore be it

RESOLVED, that the Town Clerk is hereby authorized to seek bids for the above-referenced materials.

RESOLUTION 12:5:05 - 4 RE: Release of One Year Maintenance Bonds - Bowe Lane, Gold Road & Clove Hollow Road


Councilwoman Barbara Zulauf offers the following and moves its adoption:


WHEREAS, the roads known as Bowe Lane, Gold Road, and Clove Hollow Road were accepted as Town Highways in 2004; and

WHEREAS, maintenance bonds were retained for one year as an assurance against defect or failure of said roads and with the stipulation that the Highway Superintendent and the Town Engineer shall inspect the roads for damages that may occur over the winter of 2004-2005; and

WHEREAS, the Highway Superintendent and the Town Engineer did inspect said roads and have not found any deterioration to any part of Bowe Lane, Gold Road, or Clove Hollow Road over the course of this past winter and recommend that the maintenance bonds be returned to the respective applicants; now therefore be it

RESOLVED that the Town Board hereby approves the return of the bonds to the respective applicants as follows:

Bowe Lane $ 32,000.00

Gold Road $ 5,000.00

Clove Hollow Rd. $ 8,190.00

RESOLUTION 12:5:05 - 5 RE: To Set Public Hearing to Amend the Code of the Town of Beekman Section 155-56 H. (5)(a) – Driveway Grades


Councilman Werner Stiegler offers the following and moves its adoption:


WHEREAS, the current Town Code section 155-56 H.(5)(a) currently calls for the maximum grade for any new driveway accessory to a single-family dwelling and connecting its off-street parking area to a street, not to exceed 10%; and

WHEREAS, the Planning Board, with the input of the Highway Superintendent and Fire Commissioners, may approve a 15% grade with the minimum requirement that the driveway be paved; and

WHEREAS, the Planning Board has had a significant amount of applicants requesting the 15% grades without study of the feasibility of 10% grades; and

WHEREAS, it is in the best interest for the safety of the town’s residents that the Fire Commissioners strongly recommend that driveways be limited to 10% grade; and

WHEREAS, the Planning Board voted to approve the elimination of the 15% grade option from the Town’s Code at their November 17, 2005 Planning Board meeting; now therefore be it

RESOLVED, that a public hearing on the revision of Section 155-56 H. (5)(a) of the Town Code be held on Monday, December 19, 2005 at 7:20 p.m. at the Town Hall, 4 Main Street, Poughquag, in the Town of Beekman, New York; and be it further

RESOLVED, that notice stating the time and place of such hearing and setting forth the proposed amendment, shall be published in the Poughkeepsie Journal, a newspaper circulating in the Town of Beekman, and posted on the signboard of the Town on or before the 9th of December, 2005.

RESOLUTION 12:5:05 - 6 RE: To Schedule a Public Hearing on Local Law Imposing a Moratorium In the Poughquag Hamlet

Councilman Daniel French offers the following and moves its adoption:


WHEREAS, the Planning Board of the Town of Beekman has requested that the Town Board impose a six month moratorium on planning approvals in the Poughquag Hamlet in order to review and revise the current Hamlet Code, Allowable Uses, appropriate Area and Bulk Regulations and any other section of the Town Code that may be appropriate to this section of the Town; now therefore be it

RESOLVED, that a public hearing on the attached Local Law shall be held on the 19th day of December, 2005 at 7:10 p.m. at the Town Hall, 4 Main Street, Poughquag, New York; and be it further

RESOLVED, that notice stating the time and place of such hearing and the purpose thereof, shall be published in the Poughkeepsie Journal, a newspaper circulating in the Town of Beekman, and posted on the signboard of the Town on or before the 9th of December, 2005.
