RESOLUTION 12:06:04 - 1 RE: To Go Out to Bid for Highway Garage Expansion

Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, pursuant to Section 6-c of the General Municipal Law, the Town of Beekman has established by resolution a capital reserve fund for highway garage expansion to accommodate additional highway vehicles added to its fleet as well as provide housing for the Town’s ambulance service; and

WHEREAS, the Town Engineer, Rohde, Soyka & Andrews, has prepared drawings, specifications and bid documents for one (1) pole barn having a total floor area of 4,680 square feet; and

WHEREAS, the cost to furnish and install the concrete floor slab, building insulation, masonry firewall, plumbing, heating, electrical and interior finishing is not included in bid documents, but will be performed by the Highway Department; now therefore be it

RESOLVED, that the Town Board hereby authorizes the Town Clerk to seek bids for one (1) pole barn with a square foot floor area of 4,680 and in accordance with the specifications provided by Rohde, Soyka & Andrews.

RESOLUTION 12:06:04 - 2 RE: Authorizing the Supervisor to Sign Contract With MJW Consulting, Inc. – Real Property Reassessment Project


Councilwoman Stella Slattery offers the following and moves its adoption:


WHEREAS, the Town of Beekman has entered into a “Municipal Cooperation Agreement” establishing the Southern Dutchess County Reassessment Consortium in order to conduct a municipal-wide reassessment project; and

WHEREAS, in accordance with said Agreement, proposals for mass appraisal services were sought and received; and

WHEREAS, the Consortium has chosen MJW Consulting, Inc. for the Real Property Reassessment Project; now therefore be it

RESOLVED, that the Supervisor is hereby authorized to enter into a contract with MJW Consulting, Inc. for the completion of the Town wide revaluation to be completed by June 1, 2007; and be it further

RESOLVED, that the Supervisor is hereby authorized to sign any and all documents associated with the Reassessment Project.

RESOLUTION 12:06:04 - 3 RE: To Declare Lead Agency and Set Public Hearing Local Law Establishing Town Center

Councilman Thomas Kinsley offers the following and moves its adoption:

WHEREAS, there are no other Involved Agencies, the Town of Beekman hereby declares that it will serve as Lead Agency in the Proposed Local Law in rezoning of 132 acres encompassing 58 individual tax parcels from C-2 Central Commercial District to TC-B, Town Center Business District and TC-R, Town Center Residential District on both sides of NYS Route 55 from Fishkill Creek on the West to Sunrise Drive on the East and to be referred to as the Town Center area; now therefore be it

RESOLVED, that a public hearing on said Local Law be held on the 20th day of December, 2004 at 7:15 o’clock p.m. at the Town Hall, 4 Main Street, Poughquag, in the Town of Beekman, New York, and that notice of the time and place of such hearing and setting forth the proposed amendment, be published once on or before the 10th day of December, 2004 in the Poughkeepsie Journal, a newspaper circulating in the Town of Beekman; and be it further

RESOLVED, that pursuant to Sect. 239 of General Municipal Law, Dutchess County Planning and Development has been provided with said proposed Local Law and will be notified of the date and time of the Public Hearing; and be it further

RESOLVED, that copies of the proposed Local Law will be available for examination and inspection in the office of the Town Clerk of the Town of Beekman between the hours of 9:00 a.m. and 4:00 p.m. on all business days.

RESOLUTION 12:06:04 - 4 RE: To Set Bond for Ginese Subdivision


Councilwoman Barbra Zulauf offers the following and moves its adoption:


WHEREAS, Rhode, Soyka & Andrews Engineering has prepared a Performance Bond Estimate dated November 18, 2004, recommending the bond be set in the amount of $675,000.00 for Ginese Subdivision; and

WHEREAS, the Planning Board adopted a resolution on November 18, 2004 to establish the bond amount as recommended by Rhode, Soyka & Andrews; now therefore be it

RESOLVED, that the Town Board hereby approves that the bond be set in the amount of $675,000.00 for Ginese Subdivision and to be furnished by the applicant for filing in the office of the Town Clerk.

RESOLUTION 12:06:04 - 5 RE: Naming of Road in Victoria Estates – Victoria Drive


Councilwoman Stella Slattery offers the following and moves its adoption:


WHEREAS, it is necessary to name the roadway in the Victoria Estates Subdivision enabling Emergency 911 vehicles to respond to emergency calls; and

WHEREAS, the proposed name has been approved by the Town of Beekman Planning Board and Dutchess County Department of Emergency Response, now therefore be it

RESOLVED, the following name is hereby approved for the road in Victoria Estates:

Victoria Drive

And be it further RESOLVED, that Dutchess County 911 be duly notified of this name so that it can be placed in the 911 database.

RESOLUTION 12:06:04 - 6 RE: Release of Wenglowski Soil Erosion & Siltation Bond

Supervisor John Adams offers the following and moves its adoption:

WHEREAS, the Town Engineer, Rhode, Soyka & Andrews as well as the Town Planner, Neal Townsend, have completed a site inspection for which a Soil Erosion and Siltation Bond was required; and

WHEREAS, it has been determined that the site is fully stabilized; now therefore be it

RESOLVED, that upon the recommendation of the Town Engineer, the Town Board authorizes the release of the Wenglowski Soil Erosion and Siltation Bond in the amount of $17,500.00.
