RESOLUTION 12:17:07 - 1 Adoption of Local Law Prohibiting Illicit Discharges, Activities and Connections to Separate Storm Sewer Systems

Councilman Werner Stiegler offers the following and moves its adoption:


WHEREAS, a public hearing was duly held on December 3, 2007 on a proposed local law providing for the health, safety and general welfare of the citizens of the Town of Beekman through regulation of non-stormwater discharges to the municipal separate storm sewer (‘MS4”) to the maximum extent practicable as required by federal and state law; and

WHEREAS, the proposed local law was made available for public review at the Town Hall; and

WHEREAS, the Town Board adopted a Negative Declaration, with respect to this action, on November 19, 2007; now therefore be it

RESOLVED, that the Town Board hereby adopts the local law to prohibit illicit discharges, activities and connections to separate storm sewer systems; and be it further

RESOLVED, that certified copies of this Local Law be filed immediately in the offices of the Beekman Town Clerk; and be it further

RESOLVED, that the Town Clerk is hereby directed to file a copy of the local law with the Secretary of State, which law shall become effective upon filing same with the Office of the Secretary of State.

RESOLUTION 12:17:07 - 2 Ambulance Provider


Supervisor John Adams offers the following and moves its adoption:


WHEREAS, the Town Board of the Town of Beekman is authorized pursuant to Section 122-b of the General Municipal Law to contract for the provision of ambulance service within the Town; and

WHEREAS, the Town’s current contract for said ambulance service is due to expire on December 31, 2007; and

WHEREAS, the Supervisor was authorized to seek proposals from local ambulance service providers for 24 hour ALS ambulance service within the Town of Beekman; and

WHEREAS, three proposals were received and reviewed by the Town Board; now therefore be it

RESOLVED, that NDP Emergency Medical Services is hereby selected to provide ambulance service for sick or injured persons found within the boundaries of the Town for a term beginning 12:01 a.m. January 1, 2008 and ending on December 31, 2008; and be it further

RESOLVED, that the Supervisor is hereby authorized to execute a contract with NDP Emergency Medical Services in accordance with the conditions outlined in the attached proposal dated November 28, 2007 at an annual fee not to exceed $329,150.00; and be it further

RESOLVED, that Dutchess County Department of Emergency Response will be duly notified of the change in ambulance provider for the Town of Beekman.

RESOLUTION 12:17:07 - 3 Authorizing Increase of User Rates for the Dover Ridge Water and Sewer District

Councilman Daniel French offers the following and moves its adoption:

WHEREAS, the Town Board of the Town of Beekman is responsible for the operation and management of the Dover Ridge Water and Sewer District; and

WHEREAS, a public hearing was duly held on December 3, 2007 on adjusting the water and sewer rates to reflect the actual costs of operating the water and sewer districts; now therefore be it

RESOLVED, that effective January 1, 2008, quarterly invoices sent to all homeowners of the Dover Ridge Estates for water usage and sewer service will reflect the following rates:

Water Usage:         $ 81.26
Sewer Service:      $214.51
