RESOLUTION 12:20:04 - 1 RE: In Support of Authorizing Submission of Grant Application - Habitat/Access Stamp Funding Program

Supervisor John Adams offers the following and moves its adoption:

WHEREAS, the Town owns a parcel of land consisting of 5.54 acres on Van Wyck Court in the Town of Beekman and which borders the Fishkill Creek; and

WHEREAS, the Town Board of the Town of Beekman is desirous in developing this land to provide public access to the creek for the sole use of recreational fishing; and

WHEREAS, funding is available through the New York State Department of Environmental Conservation (NYSDEC) for access projects which provide access to hunting, fishing, trapping or other fish and wildlife related recreation and study; and

WHEREAS, the Town Board of the Town of Beekman in conjunction with the Conservation Advisory Council wishes to submit a grant application to the NYSDEC for consideration of funding up to $14,999.00; now therefore be it

RESOLVED, that the Supervisor of the Town of Beekman is hereby authorized and directed to file an application for funds from the Habitat/Access Stamp Funding Program in an amount not to exceed $14,999.00, and upon approval of said request to enter into and execute a project agreement with the New York State Department of Environmental Conservation for such financial assistance to the Town of Beekman for the Beekman/Fishkill Creek Recreational Access Project and further, to carry out and comply with the terms of such project agreement.

RESOLUTION 12:20:04 - 2 RE: Authorizing the Purchase of New Docks Recreation Center Park

Councilwoman Barbara Zulauf offers the following and moves its adoption:

WHEREAS, pursuant to Sect. 64 and Article 14 of Town Law, the Town Board has authority for the management, custody and control of all Town lands, buildings and property and to keep such facilities in good repair; and has authority for the general management and control of Town finances; and

WHEREAS, the wooden docks at Recreation Center Park used by the lifeguards for training and the swim team for practice and swim meets are deteriorating due to their age and pose a danger to both patrons and staff; and

WHEREAS, the Recreation Director recommends replacing these docks with the Alumidock System making it compatible with the topography of the Beekman Recreation Park waterfront as well as the existing Alumidock ramps and connecting walkway creating a safe environment; and

WHEREAS, the Dutchess County Health Department has approved the additional Alumidoc System of docks and design submitted by the Recreation Department; now therefore be it

RESOLVED, that the Town Board hereby approves the proposal from Alumidock in the amount of $34,588.24; and be it further

RESOLVED, that this expenditure be charged to the Special Recreation Fund (SRF) account.

RESOLUTION 12:20:04 - 3 RE: To Seek Proposals for 2005 Highway Materials

Councilwoman Stella Slattery offers the following and moves its adoption:

WHEREAS, the Highway Superintendent has requested that the Town Board authorize the Department to seek bids for highway materials for the year 2005; now therefore be it

RESOLVED, that the Town Clerk is hereby authorized to seek bids for the above-referenced materials.

RESOLUTION 12:20:04 - 4 RE: Personnel Manual Revisions

Councilwoman Stella Slattery offers the following and moves its adoption:

WHEREAS, the Town Board is responsible for the supervision and administration of all personnel matters in connection with Town employees; and

WHEREAS, the Town Board has reviewed the current Personnel Manual and finds it warrants changes that are fair and equitable as well as address the permanent part-time employees; and

WHEREAS, certain language in the current Personnel Manual is not clear and concise and creates varied interpretations; and

WHEREAS, employee contributions to their health insurance will alleviate some of the burden of the ever increasing costs of health insurance to the Town; and

WHEREAS, it has been proposed that simulating the CSEA contract, current employees covered under the health plan will contribute five (5%) percent of the cost of the health care premiums for either joint or individual coverage; ten (10%) percent for family coverage and all new employees hired after December 31, 2004 shall provide ten (10%) percent of the premiums regardless of whether they receive individual, joint or family coverage; now therefore be it

RESOLVED, that the Town Board hereby accepts the attached revised Town of Beekman Personnel Manual, as the official personnel policies and procedures of the Town to be effective January 1, 2005; and be it further

RESOLVED; that each Town employee and elected official will be given a copy of the Personnel Manual along with a receipt to be signed and filed with the Town’s Personnel Officer.

RESOLUTION 12:20:04 - 5 RE: Authorizing Attendance at Turf and Lawn Training Seminar

Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, Pesticide Training and Consulting will be holding recertification courses on “Managing Lawn, Turf & Ornamental Pests” on February 10, 2005 in Poughkeepsie, New York; and

WHEREAS, the cost of $100.00 has been included in the 2005 budget; now therefore be it

RESOLVED, that Gregory Brown, Maintenance Mechanic, is hereby authorized to attend said recertification course.

RESOLUTION 12:20:04 - 6 RE: Acceptance of YDDP Grant

Councilman Thomas Kinsley offers the following and moves its adoption:

WHEREAS, the Town of Beekman has submitted a 2005 Youth Development Delinquency Prevention (YDDP) application to the Dutchess County Youth Bureau for “Recreation Youth Basketball League”; and

WHEREAS, by letter dated December 2, 2004, the Dutchess County Youth Bureau notified the Town of Beekman that the Town’s YDDP application has been approved in the amount of $3,982.00, which grant program is funded in part through the New York State Office of Children and Family Services with the assistance of the Dutchess County Youth Bureau; now therefore be it

RESOLVED, that the Supervisor of the Town of Beekman, John D. Adams, and the Beekman Town Board hereby authorize and ratify the YDDP application to the New York State Office of Children and Family Services and the Dutchess County Youth Bureau, agree to abide by all stated grant requirements and hereby accept these 2005 grant funds for the purpose herein above stated; and be it further

RESOLVED, that the Supervisor be and hereby authorized and empowered to take all steps necessary to implement this resolution which shall take effect immediately.
