RE: RESOLUTION INTRODUCING “LOCAL LAW NO. 3 OF THE YEAR 2021, A LOCAL LAW ADOPTED PURSUANT TO CANNABIS LAW § 131 OPTING OUT OF LICENSING AND ESTABLISHING ON-SITE CANNABIS CONSUMPTION ESTABLISHMENTS WITHIN THE TOWN OF BEEKMAN”
WHEREAS, pursuant to Cannabis Law § 131, the Town of Beekman desires to opt-out of hosting on-site consumption establishments within its boundaries; and
WHEREAS, the Town Board has determined that pursuant to 6 NYCRR 617.5 (c) (20) the proposed adoption of the aforementioned Local Law is a Type II action not requiring environmental review pursuant to State Environmental Quality Review Act (SEQRA) and, accordingly, no environmental review has been undertaken;
NOW, THEREFORE
BE IT RESOLVED, that the Town Board hereby introduces for consideration of its adoption proposed “Local Law No. 3 of the Year 2021, A Local Law Adopted Pursuant to Cannabis Law § 131 Opting Out of Licensing and Establishing On-site Cannabis Consumption Establishment within the Town of Beekman”, in the form annexed hereto; and
BE IT FURTHER RESOLVED, that the Town Board hereby schedules a Public Hearing regarding the proposed adoption of the annexed Local Law for 7:00 P.M., on the 12th day of October, 2021, to be held at Town Hall, 4 Main Street, Poughquag, New York, and the Town Clerk is directed to post the Notice of Public Hearing in the form annexed hereto and to publish same in the newspaper not less than ten (10) days nor more than twenty (20) days prior to the Public Hearing as required by law; and
BE IT FURTHER RESOLVED, that this Local Law is subject to a permissive referendum.

Town of Beekman
Local Law No. 3 of the year 2021
A local law adopted pursuant to Cannabis Law § 131 opting out of licensing and establishing on-site cannabis consumption establishments within the Town of Beekman.
Section 1. Legislative Intent
It is the intent of this local law to opt the Town of Beekman out of hosting on-site cannabis consumption establishments within its boundaries.
Section 2.  Authority
This local law is adopted pursuant to Cannabis Law § 131, which expressly authorizes cities and villages to opt-out of allowing on-site cannabis consumption establishments to locate and operate within their boundaries.
Section 3.  Local Cannabis Retail Dispensary and/or On-Site Consumption Opt-Out
The Town Board of the Town of Beekman, County of Dutchess, hereby opts-out of allowing on-site cannabis consumption establishments from locating and operating within the boundaries of the Town of Beekman.
Section 4.  Severability
If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the court’s order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.
Section 5.       Numbering for Codification
It is the intention of the Town of Beekman and it is hereby enacted that the provisions of this Local Law shall be included in the Code of the Town of Beekman; that the sections and subsections of this Local Law may be re-numbered or re-lettered by the Codifier to accomplish such intention; that the Codifier shall make no substantive changes to this Local Law; that the words “Local Law” shall be changed to “Chapter,” “Section,” or other appropriate word as required for codification; and that any such rearranging of the numbering and editing shall not affect the validity of this Local Law or the provisions of the Code affected thereby.
Section 6.  Effective date
This local law shall take effect immediately upon filing with the Secretary of State.  Pursuant to Cannabis Law § 131, this local law is subject to a permissive referendum and thus may not be filed with the Secretary of State until the applicable time period has elapsed to file a petition or a referendum has been conducted approving this local law.

RE: SETTING PLANNING BOARD TO FIVE MEMBERS
WHEREAS, Town Law §271 authorizes the Town Board to create a Planning Board consisting of either five or seven members, and shall by resolution, appoint the members of such board and designate the chairperson thereof, and
WHEREAS, the Town Board feels it is in the best interest of the Town, along with the advisement of the Town Attorney , the Town Engineer and the Planning Board Chair, to set the number of members on the Town Planning Board to 5 (five) to ensure the avoidance of cancelling meetings due to the lack of a quorum.
NOW, THEREFORE
BE IT RESOLVED that the Town Board hereby sets the number of members on the Town of Beekman Planning Board to five (5); and
BE IT FURTHER RESOLVED, that this take effect immediately.

RE: AWARD THE BID FOR CLEAN UP DAY
WHEREAS, Town clean-up day has been scheduled for Saturday, October 23, 2021 between the hours of 7:00 am and 2:00 pm in the Town Hall parking lot; and
WHEREAS, bids were received for services as described in the legally published notice and opened and read publicly by the Town Clerk on Tuesday, September 21, 2021 at 10:00 am;
NOW, THEREFORE,

RE:  AUTHORIZE TO GO OUT TO BID FOR NEW ROOF FOR TOWN HALL
WHEREAS, the Town Engineer has requested that the Town Board authorize MAAD Architects to release a Request for Bids package on or about October 1, 2021 for the purpose of releasing bidding documents related to the replacement of the Town Hall roof;
NOW, THEREFORE,
BE IT RESOLVED, that the Town Clerk is hereby authorized to seek bids for the Replacement of the Town Hall Roof; and
BE IT FURTHER RESOLVED, that prior to publication, bid documents are to be reviewed by the Town Engineer and the Town Attorney, and
BE IT FURTHER RESOLVED, that the request for bids shall be in accordance with the Town of Beekman Procurement Policy;
NOW, THEREFORE,
BE IT RESOLVED, that the Town Clerk is hereby authorized to advertise for bids for the replacement of the Town Hall Roof as attached here within, in the Poughkeepsie Journal, on the Bulletin Board in the Town Clerk’s Office, and on the homepage of the Town of Beekman Website.

RE: SMOKING AND VAPING RESTRICTIONS ON TOWN PROPERTIES
WHEREAS, the Town Board is in recognition of NYS Public Health (PBH) Chapter 45, Article 13-E, Section 1399-0, known as the “Clean Indoor Air Act” Smoking and Vaping Restrictions, amended 2019-06-21.
NOW, THEREFORE,
BE IT RESOLVED, that Smoking and vaping shall not be permitted and no person shall smoke or vape in or on any Town of Beekman properties; and
BE IT FURTHER RESOLVED, that signs stating such have been purchased and will be prominently placed at all Town Facilities.

RESOLUTION 09:28:21-10 (151)
RE: APPOINTMENT OF LAURA WONG-PAN, ESQ.
WHEREAS, an employee of the Town of Beekman filed a Workplace Violence Incident Report (“Report”) with the Town Supervisor’s Office on September 23, 2021; and
WHEREAS, the Report was referred to the Town’s Workplace Violence Committee; and
WHEREAS, the Workplace Violence Committee has recommended the Report be investigated by an independent investigator who is neither employed by nor affiliated with the Town; and
WHEREAS, the Town Attorney has recommended that the Town engage the services of Laura Wong-Pan, Esq., to perform the investigation of the Report; now, therefore, be it
RESOLVED, that the Town Board of the Town of Beekman retains the services of Laura Wong-Pan, Esq., to investigate and report any recommendations to the Town Board with respect to the Reports; and be it further
RESOLVED, that Ms. Wong-Pan shall be compensated at the rate of $200 per hour for her services; and be it further
RESOLVED, that the Town Supervisor is authorized to execute any documentation in connection with the action approved by this Resolution.
