RE: Approve Abandoned Properties
COUNCILMAN BATTAGLINI              offers the following and moves for its adoption:
WHEREAS, a public hearing was duly held on October 18, 2017 before the Town Board to accept abandoned properties in the Town of Beekman; and  
WHEREAS, comments were received by residents for consideration of the Town Board; and  
WHEREAS, no written comments were received within the allotted time period to the Town Clerk; now therefore be it 
RESOLVED, that the Town Board of the Town of Beekman authorize Town Departments to bring the following properties into compliance with the Town Code of abandoned properties as noted in Chapter 14:

RESOLUTION NO. 11:01:17 – 3 (173)
RE: Authorize Town Clerk to Advertise a Request for Bids for Scrap Metal 
SUPERVISOR ZULAUF             offers the following and moves for its adoption: 
WHEREAS, the Town held its annual Clean-Up Day on October 21, 2017, and has received a sizeable volume of old equipment and materials that need to be disposed of; and  
WHEREAS, the Highway Superintendent has recommended that these materials be sold for scrap, as the materials cannot be used by the Highway Department; now therefore be it  
RESOLVED, that the Town Board hereby authorizes the Town Clerk to advertise a request for bids for the sale and removal of scrap metal located at the Beekman Highway Department.

RE: Authorize Town Clerk to Advertise a Request for Bids for Cleaning Services for Town Buildings 
COUNCILMAN DEL VECCHIO          offers the following and moves for its adoption: 
WHEREAS, the Town Board is desirous in searching for Cleaning Services for the Town Hall, Highway Superintendent’s Office, and the Sheriff Sub Station; and 
WHEREAS, the current contract with Dutchess County ARC is set to expire on December 31, 2017; now therefore be it 
RESOLVED, that that the Town Board authorizes the Town Clerk to advertise a Request for Bids for Cleaning Services for the Town Hall, Highway Superintendent’s Office, and the Sheriff Sub Station.

RESOLUTION NO. 11:01:17 – 5 (175)
RE: Approve Amendments to Dutchess County Sheriff’s Office Contract 
COUNCILWOMAN COVUCCI               offers the following and moves for its adoption: 
WHEREAS, an agreement between the Dutchess County Sheriff’s Office and the Town of Beekman was approved on January 28, 2004; and 
WHEREAS, the Town Board is desirous in continuing the Dutchess County Sheriff’s Department to provide police protection over and above the police protection budgeted and allocated for the Town, including security services at Town Court; and 
WHEREAS, the Dutchess County Sheriff’s Office has proposed amendments as per the attached 2018 Administrative Fee Schedule; now therefore be it 
RESOLVED, that the town Board authorizes the proposed amendments between Dutchess County and the Town of Beekman as per the attachments.

RE: Approve Training at Downstate Recreation Conference 
COUNCILMAN STIEGLER                  offers the following and moves for its adoption: 
WHEREAS, the New York State Recreation and Parks Service will be holding their annual Downstate Conference on November 14, 2017 in White Plains, NY; and 
WHEREAS, the workshops scheduled throughout the day will be beneficial to our Recreation Department; and 
WHEREAS, funds for training has been included in the 2017 Recreation Budget; and 
WHEREAS, Recreation Director, Jeanne Scigliano is on the Downstate Recreation Committee, and has the opportunity to attend at no charge; and 
WHEREAS, Dani Plastini, Assistant to the Recreation Director, would benefit by attending this Recreation conference; now therefore be it 
RESOLVED, that Jeanne Scigliano is hereby authorized to attend at no charge, and Dani Plastini is hereby authorized to attend the Downstate Recreation Conference with a fee not to exceed $70.00

RE: Approve Attendance at Dutchess County Grant Writing Workshop 
COUNCILMAN BATTAGLINI                offers the following and moves for its adoption: 
WHEREAS, the Dutchess County Department of Community and Family Services Division of Youth Services is requesting applications for Youth Program Funding; and 
WHEREAS, the Town of Beekman Recreation Department has been successful in receiving grant funding for the Beekman Teen Leadership Council; and 
WHEREAS, it is required by the Division of Youth Services to attend one grant workshop for applicants; now therefore be it 
RESOLVED, that Jeanne Scigliano, Recreation Director and Lauren Laurita, Activities Director        are hereby authorized to attend one of the grant workshops, at no cost to the Town.

RE: Authorize Entertainment for the Snowflake Spectacular 
SUPERVISOR ZULAUF                      offers the following and moves for its adoption: 
WHEREAS, the annual Snowflake Spectacular, organized by the Recreation Department, will be held on December 2, 2017; and  
WHEREAS, funds for entertainment at the Snowflake Spectacular were included in the 2017 budget; now therefore be it  
RESOLVED, that the Town Board hereby authorizes the Supervisor to enter into an agreement with DJ Dolce Productions, with a fee not to exceed $195.00 and with TUMBLEBUS, with a fee not to exceed $400 for the 2017 Snowflake Spectacular.

RE: Approve Stone Ridge Estates Sewer Rates 
COUNCILWOMAN COVUCCI              offers the following and moves for its adoption: 
WHEREAS, the Stone Ridge Subdivision in the Town of Beekman, County of Dutchess and State of New York is serviced by a private sewage corporation known as the “Stone Ridge Estates Sewage Corporation (the “Sewer Corporation”)” which corporation was formed pursuant to the New York State Transportation Corporations Law (“TCL”); and 
               WHEREAS, the Sewer Corporation operates under an agreement with the Town of East
               Fishkill, whereby the Town of East Fishkill operating on behalf of the Four Corners Water and
               Sewer District accepts domestic waste from the 18 lot subdivision; and 
WHEREAS, pursuant to Section 121 of the Transportation Corporations Law, the Town Board has the authority to set the rates for the Sewer Corporation after petition by the Sewer Corporation; and 
WHEREAS, the Town Clerk received the Initial Rate Petition from the Sewer Corporation who purposes the rate to be $125 per month for a single-family home or equivalent which rate computation is set forth in the Sewer Corporation’s Petition; now therefore be it 
RESOLVED, that the Town Board of the Town of Beekman pursuant to Section 121 of the Transportation Corporations Law, hereby accepts the Initial Rate Petition on behalf of the Stone Ridge Estates Sewage Corporation and consents to the initial rate of $125 per month for a single-family home or equivalent.

RESOLUTION NO. 11:01:17 – OTHER BUSINESS
RE: Accept a Drainage Easement Granted by Nicolosi Buildings Inc. 
COUNCILMAN STIEGLER              offers the following and moves for its adoption: 
WHEREAS,insufficient drainage exists in an area located in the Town of Beekman, County of Dutchess and State of New York, as more specifically shown on a plan of subdivision entitled, "Maple Farms Estates,” dated February 7, 2002, last revised February 16, 2005, and filed in the Dutchess County Clerk's Office on March 18, 2005 as Filed Map No. 11783, which results in flooding, soil erosion and increased maintenance and repair costs to the Town of Beekman; and 
WHEREAS, Nicolosi Buildings, Inc. (“Grantor”), having its offices at 21 Cambridge Street, Highland, New York 12528, the owner in fee of a parcel of real estate known as “Maple Farms Estates,” has agreed to permit a portion of their property to be used to aid the drainage of water from said property, all as depicted in the Filed Map No. 11783; and 
WHEREAS, Grantor in consideration of One Dollar ($1.00), lawful money of the United States paid by the Town of Beekman, receipt of which is hereby waived, and other good and lawful consideration, has agreed to grant and release unto the Town of Beekman (“Grantee”), its successors and assigns forever, apermanent easement over that portion of the property located in Maple Farms Estates shown as the “Detention Pond Easement”, which area is described more fully in the Schedule “A” attached to the Drainage Easement and referred to hereinafter as the “Drainage Easement Area;” and 
WHEREAS, under the terms of the Drainage Easement, Grantor is prohibited from blocking or obstructing the Drainage Easement Area above or below grade or planting trees or substantial shrubs within the easement area or constructing and/or maintaining any type of permanent or temporary structure including, but not limited to, underground pipes and conduits in, on, under or over the easement area without written permission of the Town of Beekman, 
NOW, THEREFORE, BE IT RESOLVED that the foregoing WHEREAS paragraphs are incorporated herein by reference and adopted; and 
BE IT FURTHER RESOLVED that the Town Board of the Town of Beekman hereby accepts the Drainage Easement from Nicolosi Buildings Inc. and authorizes the Supervisor to sign said Drainage Easement, and to execute and deliver any and all required documentation for filing of the Drainage Easement with the Office of the Dutchess County Clerk.
