WHEREAS, Town Clerk Rachael Rancourt has provided copies of the minutes of the July 20, 2016 Town Board Meeting to all members of the Beekman Town Board; and
WHEREAS, Town Board members have had the opportunity to review said minutes; now therefore be it

RESOLUTION NO. 08:10:16 – 2 (92)
RE: Rebid Dover Ridge Generator
COUNCILMAN BATTAGLINI          offers the following and moves for its adoption:
WHEREAS, on June 1, 2016 the Town Clerk was authorized to advertise a Request for Proposal (RFP) for a generator for Dover Ridge; and
WHEREAS, the bids were opened and read publicly on June 29, 2016 at 10:00 am; and
WHEREAS, the Town Board rejected the received bids at the July 20, 2016 Town Board Meeting; and
WHEREAS, the Town Board requested that the Town Engineer make appropriate changes to the Request for Proposal (RFP) to better suit the needs of this generator project at Dover Ridge; and
WHEREAS, the Town Engineer has made these changes for the generator at Dover Ridge; now therefore be it
RESOLVED, that the Town Clerk is hereby authorized to post the Request for Proposal (RFP) as attached here within, in the Poughkeepsie Journal, on the bulletin Board in the Town Clerk Office, and on the homepage of the Town of Beekman website.

RE: SEQRA Determination for Local Law No. 1 of 2016, Amending the Town’s Zoning Map For The Purpose of Rezoning a Certain Property From Poughquag Hamlet (PH) To Highway Commercial (C-2)
COUNCILMAN DEL VECCHIO         offers the following and moves for its adoption:
WHEREAS, the Town Board of the Town of Beekman has the ability to adopt local laws and to amend the zoning code; and 
WHEREAS, pursuant to Part 617 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review Act) (“SEQRA”) of the Environmental Conservation Law, the Town Board is obligated to conduct an environmental review and assess the environmental impact of amending the zoning code as proposed; and 
WHEREAS, the Town Board is desirous of becoming the lead agency for purposes of this environmental review; and 
WHEREAS, the Town Board has determined that there are no other interested or involved agencies, as those terms are defined in the SEQRA regulations; and 
WHEREAS, the Town Board has determined that the proposed action is an unlisted action under the SEQRA regulations; and 
WHEREAS, the Town Board notes that the subject parcel is presently improved with buildings housing a commercial use, and is surrounded by commercial uses, some of which are under common ownership with the subject parcel; and 
WHEREAS, the Town Board therefore finds that the proposed zoning change is largely a paper change to bring the parcel’s zoning into conformity with that of surrounding parcels and its present use, and will have little or no effect on the surrounding properties or the environment; now therefore be it 
RESOLVED, that the Town of Beekman finds that there are no other interested or involved agencies, as those terms are defined in the SEQRA regulations; and be it further 
RESOLVED, that the Town of Beekman declares itself to be the lead agency for the SEQRA determination for this project; and be it further 
RESOLVED, that the Town of Beekman finds that this is an unlisted action; and be it further 
RESOLVED, that the Town of Beekman finds that no adverse environmental impacts will occur as a result of the proposed action and accordingly adopts the attached negative declaration.

RESOLUTION NO. 08:10:16 – 5 (94)
RE: Adopt Local Law 1-2016 to Amend Chapter 155 of Zoning Law for Law Tax Parcel #6758-00-941778
COUNCILMAN STIEGLER       offers the following and moves for its adoption:
Whereas, after reviewing the criteria set forth in § 155-72 of the Town Code, the Town Board believes that it is reasonable and appropriate, and in the best interests of the residents of the Town, to amend the Zoning Map associated with Chapter 155-6 of the Town Code to rezone a certain parcel of property from the “Poughquag Hamlet (PH)” Zoning District to the “Highway Commercial (C-2)” Zoning District; and
WHEREAS, Local Law No. 1 of 2016 reflects this determination by the Town Board; and
WHEREAS, a resolution was duly adopted by the Town of Beekman Town Board to hold a public hearing on the proposed adoption of Local Law No. 1 of 2016, entitled “A Local Law Amending the Town’s Zoning Map for the Purpose of Rezoning a Property from Poughquag Hamlet (PH) to Highway Commercial (C-2);” and
WHEREAS, notice of said public hearing was timely published in the Poughkeepsie Journal and was posted on the Town’s website and the Town Clerk’s bulletin board; and
WHEREAS, on July 20, 2016 the Beekman Town Board held a duly-noticed public hearing concerning the adoption of the proposed Local Law, during which all who wished to speak in favor of, or in opposition to, the proposed Local Law, or any part thereof, were heard; and
WHEREAS, no one appeared at the public hearing in opposition to the proposed Local Law and no correspondence has been received in opposition to the proposed Local Law; and
WHEREAS, pursuant to Part 17 of the Implementing Regulations pertaining to Article 8 (State Environmental Quality Review Act) (“SEQRA”), the Town Board determined that the adoption of the Local Law changing the zoning of this parcel constituted an Unlisted Action as defined under said regulations; and
WHEREAS, the Town Board determined that there were no other involved or interested agencies, as those terms are defined in the SEQRA regulations, and declared itself to be Lead Agency; and
WHEREAS, after due consideration being given to the environmental impact of the proposed action, the Town Board determined that the proposed action would not have a significant environmental impact and thereafter issued a Determination of Non-Significance - Negative Declaration on August 10, 2016; and
WHEREAS, pursuant to General Municipal Law § 239-m, the matter was referred to the Dutchess County Department of Planning and Development, which determined that the proposed Local Law was a matter of local concern; and
WHEREAS, the Town Board, after due deliberation, finds that it is in the best interest of the Town to adopt the Local Law, now therefore be it
RESOLVED, that Local Law No. 1 of 2016, a true and correct copy of which is attached hereto and incorporated by reference as if fully set forth here, be, and hereby is, adopted; and be it further
RESOLVED, that the Town Clerk is directed to enter this Local Law in the minutes of this meeting, and be it further
RESOLVED, that, in accordance with § 21 of Municipal Home Rule Law, the final adopted copy of this Local Law shall be presented to the Supervisor for approval, and upon such approval of the Supervisor (or other approval occurring pursuant to § 21 of Municipal Home Rule Law), and within 20 days of the final adoption of this Local Law, the Town Clerk shall, and is hereby directed to, file a certified copy of the Local Law, together with the required certifications, in the Office of the Town Clerk and with the Secretary of State as required by Municipal Home Rule Law § 27.

RE: Appointment of Lauren Laurita to Temporary Recreation Assistant
COUNCILMAN BATTAGLINI       offers the following and moves for its adoption:
WHEREAS, Town Law states that the Town Board shall make appointments and set salaries; and
WHEREAS, the Town Board is desirous in filling the position of Temporary Recreation Assistant; and
WHEREAS, current Recreation employee Lauren Laurita, has received a recommendation of the Recreation Director, Jeanne Scigliano, now therefore be it
RESOLVED, that the Town Board hereby appoints Lauren Laurita as Temporary Recreation Assistant as of September 6, 2016, with an hourly salary of $16 per hour.

RESOLUTION NO. 08:10:16 – 7 (96)
RE: Appointment of Dutchess County MS4 Coordination Committee Representative Councilman Ezio Battaglini
COUNCILMAN DEL VECCHIO       offers the following and moves for its adoption:
WHEREAS, the SPDES General Permit for Storm Water Discharges from MS4’s requires that the Town develop, implement and enforce a storm water management program (SWMP) designed to reduce the discharge of pollutants from the town’s storm sewer system to the maximum extent practicable as required by federal and state law: and 
WHEREAS, the Town of Beekman is an active member in the Dutchess County MS4 Coordinator Committee; and 
WHEREAS, the Town of Beekman continues to recognize the committee as integral to the safety and efficiency of our Town’s soil and water infrastructure; and 
WHEREAS, membership allows the Town of Beekman to assign a representative to represent the town and vote in committee procedures; now therefore be it 
RESOLVED, that the Town of Beekman appoints Councilman Ezio Battaglini to represent the Town of Beekman on the Dutchess County MS4 Coordination Committee and Supervisor Barbara Zulauf as an alternate member.

RE: Appointment of Secretary to Highway Department
COUNCILMAN STIEGLER    offers the following and moves for its adoption:
WHEREAS, the Town Board is desirous in filling the established position of Highway Department Secretary; and
WHEREAS, the Town Board is authorized under Town Law to make appointments and set salaries; now therefore be it
RESOLVED, that Joanne LaTuso is hereby appointed as Secretary to Highway Department, performing all the duties and with the authority conferred or imposed by law at a salary of $15.50 per hour, and not to exceed 17 ½ hours per week, and shall serve at the pleasure of the Town Board.

RESOLUTION NO. 08:10:16 – 9 (98)
RE: Approve Fees for Senior Picnic for Non-Residents
COUNCILMAN BATTAGLINI          offers the following and moves for its adoption:
WHEREAS, the annual Senior Picnic is scheduled to be held on Thursday September 22, 2016; and 
WHEREAS, to be consistent with the fee procedures for non-residents in other Town programs and events, a schedule for fees has been established; now therefore be it   
RESOLVED, that Town of Beekman senior residents shall be admitted to the Senior Picnic free of charge; and be it further 
RESOLVED, that non-resident seniors and non-seniors that have already been “grandfathered” into other senior events will be charged $5.00 to attend the Senior Picnic, and all other non-resident seniors and non-seniors will be charged $10.00 to attend the picnic; and be it further 
RESOLVED, that the Recreation Department is authorized to collect these fees in accordance with all Town of Beekman policies.

RESOLUTION NO. 08:10:16 – 10 (99)
RE: Approve Fees for Fall Festival for Non-Residents
COUNCILMAN DEL VECCHIO      offers the following and moves for its adoption:
WHEREAS, the annual Fall Festival is scheduled to be held on October 15, 2016; and 
WHEREAS, there has been a significant increase in attendance at events operated by the Recreation Department; and 
WHEREAS, the Town Board is desirous in the safety of the public at large and concerned about overcrowding at Beekman taxpayer subsidized events, and 
WHEREAS, the Recreation Director, in conjunction with the Town Board, have approved the establishment of a fee structure for Beekman residents, non-residents and vendors; now therefore be it   
RESOLVED, all Beekman residents and their guests, program participants and their guests and Town Staff and their guests will be admitted to the Fall Festival free of charge; and be it further 
RESOLVED, that all non-residents with their guests will be charged a fee of $10 before October 11, 2016 and the fee will increase to $15.00 from October 12, 2016 thru the event; and be it further 
RESOLVED, that all vendors will be charged a fee, $30.00 for non-food vendors and $50.00 for Food/Food Truck Vendors, and be it further 
RESOLVED, that the Recreation Department is authorized to collect these fees in accordance with all Town of Beekman policies.

RESOLUTION NO. 08:10:16 – 11 (100)
RE:Accept Bid to Retain Services of Tank Testing Company for Dover Ridge
COUNCILMAN STIEGLER           offers the following and moves for its adoption:
WHEREAS, Dutchess County Board of Health has inspected the Dover Ridge Estates Water Supply; and
WHEREAS, the Dutchess County Board of Health has offered their recommendations for certain items to be further investigated including the condition of the pressure tank in the Dover Ridge Water Facility; and
WHEREAS, two proposals were received and reviewed by Jon Bodendorf, Town Engineer; and
WHEREAS, the Town Engineer has offered his recommendation to retain the services of Utility Services Co., Inc. for the pressure tank inspection at the Dover Ridge Water Facility with a fee of $4,350.00; now therefore be it
RESOLVED, that the Town Board authorizes the Supervisor to enter into an agreement with Utility Services Co., Inc for the pressure tank inspection at the Dover Ridge Water Facility with a rate not to exceed $4,350.00
