RE: APPROVAL OF PAST TOWN BOARD MEETINGS
COUNCILMAN STIEGLER:                                         offers the following and moves for its adoption:
WHEREAS, Town Clerk Laureen Abbatantuono has provided copies of the minutes of the March 24, 2020 Town Board Meeting to all members of the Beekman Town Board; and
WHEREAS, Town Board members have had the opportunity to review said minutes; now therefore be it
RESOLVED, the Town Board hereby adopts the minutes of the March 24, 2020 Town Board Meeting.

RE: AMEND WORKPLACE VIOLENCE PREVENTION POLICY
COUNCILMAN BATTAGLINI                            offers the following and moves for its adoption:
WHEREAS, the Town Of Beekman’s Workplace Violence Prevention Policy was adopted on December 1, 2008 with revisions on November 16, 2011; January 6, 2016; June 21, 2017; and
WHEREAS, the Town Board is desirous in revising the “Incident Response Team” section of the Workplace Violence Prevention Policy; now therefore be it
RESOLVED, that the Town Board make the following revisions to the “Incident Response Team” section of the Workplace Violence Prevention Policy:

RESOLUTION NO. 04:28:20 - 4 (70)
RE: ACCEPT DONATION OF FARM IMPLEMENTS
COUNCILMAN SWARTZ                                           offers the following and moves for its adoption:
WHEREAS, Judy Moran (nee Thompson), who formerly resided at the Millard Farm located at the intersection of Pleasant Ridge Road and Gardner Hollow Road has offered to donate to the town various implements used on the farm; and
WHEREAS, Town Board resolutions are required to accept all donations, now therefore be it
RESOLVED, that the Town Board does herby accept this donation and in doing so, does express it’s gratitude to Ms. Moran and be it further
RESOLVED, that the record of this donation will be forwarded to the Town Clerk for her record of donations.

RESOLUTION NO. 04:28:20 - 5 (71)
RE: APPROVE THE POSTING OF A PERFORMANCE BOND WITH THE TOWN CLERK FOR THE APPLICATION OF BEEKMAN SELF STORAGE
COUNCILWOMAN WOHRMAN                                          offers the following and moves for its adoption:
WHEREAS, on November 21, 2019 the Planning Board of the Town of Beekman granted conditional final site plan and special use permit for the application known as “Beekman Self Storage”; and
WHEREAS, the project proposes certain improvements that if not completed could pose a hazard to health and safety, and/or could cause an adverse impact to the environment; and
 
WHEREAS, pursuant to Sections 128-7; 129 and 155 of the Beekman Code, the specified land development activities require the posting of a construction completion guarantee; and
 
WHEREAS, the Town Engineer has submitted to the Planning Board a performance bond estimate whereby he recommends the posting of a performance bond in the amount of $99,220.00 for the full performance of the developers obligations pursuant to the approved site plan and special permit; and
 
WHEREAS, by resolution of the Planning Board dated November 21, 2019, the Planning Board recommended to the Town Board that the Town Board accept for posting with the Town Clerk a performance bond in the amount of $99,220.00; and
 
WHEREAS, the Town Board is desirous of accepting the recommendation of the Planning Board; and
 
WHEREAS, the Town Attorney has reviewed the proposed performance bond and finds same acceptable; and
NOW, THEREFORE,
BE IT RESOLVED, the Town Board of the Town of Beekman hereby approves and accepts the recommendation of the Planning Board with respect to the Application of Beekman Self Storage which received conditional approval and hereby sets the required performance bond in the amount of $99,220.00; and be it further
RESOLVED, that prior to signing of the plat by the Chairman of the Planning Board a performance bond shall be deposited with the Town Clerk in the amount of $99,220.00 in form and substance as acceptable to the Town Attorney; and be it further
RESOLVED, that prior to the signing of the plat by the Chairman of the Planning Board all inspection fees shall be paid to the Comptroller of the Town of Beekman.

RE: ACCEPTING THE RESIGNATION OF TAMARA LABARBERA
COUNCILMAN STIEGLER                       offers the following and moves for its adoption:          
WHEREAS,                         the Town Board makes appointments to various boards, and 
WHEREAS Tamara LaBarbera has submitted her resignation as a member of the Board of Assessment Review affective April 21, 2020                       
NOW, therefore be it resolved that the Town Board accepts the resignation of Tamara LaBarbera and would like to thank her for her many years of service to the town.

RESOLUTION NO. 04:28:20 - 7 (73)
RE: APPROVING CHANGE ORDER #1 & #2 TO THE DOVER RIDGE WATER SUPPLY-SYSTEM IMPROVEMENT PROJECT.
COUNCILMAN BATTAGLINI                                     Offers the following and moves for its adoption:
WHEREAS, the Town Board of the Town of Beekman by Resolution No. 10:09:2019-5 awarded a contract to Eventus Construction Company, Inc. (the, “Contractor”) for certain improvements to the Dover Ridge Water System in an amount not to exceed $350,000; and
WHEREAS, an unforeseen condition in the field has led to a request by the Contractor to submit two change orders to the Town that will result in a net project increase of $18,922.10; and
WHEREAS, the Town Engineer has reviewed Change Order #1 that will result in a credit of $24,790.00 and Change Order #2 which will result in a project increase of $43,712.10; and
WHEREAS, the Town Engineer has recommended the Town approve both change orders and has submitted his report and recommendations along with the Contractor’s Application for Payment; and
WHEREAS, the Town Board finds that it is in the best interest for the benefit of the users of the Dover Ridge Water Supply to approve Change Order #1 and Change Order #2 to the Dover Ridge Water Supply-System Improvement Project;  
NOW, THERERFORE, BE IT RESOLVED, that the Town Board of the Town of Beekman approves Change Order # 1 to the Dover Ridge Water Supply-System Improvement Project which will result in a credit in the amount of $24,790.00 as recommended by the Town Engineer and detailed on the Contractor’s Application for Payment Form, resulting in a net contract price of $325,210.00; and be it further
RESOLVED, that the Town Board of the Town of Beekman approves Change Order #2 to the Dover Ridge Water Supply-System Improvement Project in the amount of $43,712.10 as recommended by the Town Engineer and detailed on the Contractor’s Application for Payment Form, resulting in a net contract price of $368,922.10 through Change Order #2; and be it further
RESOLVED, that the Supervisor of the Town of Beekman is hereby authorized to sign any and all documents giving effect to this resolution, including but not limited to the requisite change orders and Contractor’s Application for Payment Form.
