RE: Approval of the Town Board Minutes

COUNCILWOMAN BARBARA ZULAUF offers the following and moves its adoption:

WHEREAS, Town Clerk Virginia Ward has provided copies of the minutes of the November 2, 2011 and November 16, 2011 Town Board Meetings to all members of the Beekman Town Board; and

WHEREAS, Town Board members have had the opportunity to review said minutes; now therefore be it

RESOLVED, the Town Board hereby adopts the minutes of the November 2, 2011 and November 16, 2011 Town Board Meetings

RESOLUTION 12:07:11 - 2
RE: Adoption of Proposed Amendments to the Town Personnel Manual

COUNCILMAN PETER BARTON offers the following and moves its adoption:

WHEREAS, the Town Board is responsible for the supervision and administration of all personnel matters in connection with Town employees; and

WHEREAS, the Town Board has reviewed the current Personnel Manual and finds it warrants changes that are fair and equitable; therefore it be

RESOLVED, that the attached additions and changes to the Town of Beekman Personnel Manual will apply to all Town Beekman employees not included in the collective bargaining agreements between the Town of Beekman and the CSEA, Local 1000 and the Town of Beekman and the International Brotherhood of Teamsters Local 456 and be it further

RESOLVED, employees covered under the Town’s health insurance plan will contribute fifteen (15%) percentage of the cost of the health insurance premium for either single, double and family coverage and be it further

RESOLVED, that “trial service period” of new employees is reduced from six months to ninety (90) days and be it further

RESOLVED, that employees hired on or before January 1, 2000 shall be entitled to continue to maintain health insurance coverage upon retirement provided the employee: (1) has been in the service of the Town for twenty years or more, (2) is at least fifty-five years of age, (3) retires directly from the Town and (4) has been granted retirement benefits from the New York State Employees’ Retirement System, and be it further

RESOLVED, the Town will make available the same health insurance and prescription plan, along with the same premium terms and conditions as is available for active employees.
However, when the retiree meets the criteria for Medicare, the primary coverage for the retiree shall be Medicare and be it further

RESOLVED, that that the Town Board hereby approves of the above listed changes to the Town of Beekman Personnel Manual, as the official personnel policies and procedures of the Town to be effective January 1, 2012; and be it further

RESOLVED; that each year-round Town employee and elected official will be given a copy of the amended Personnel Manual along with a receipt to be signed and filed with the Town’s Personnel Officer.

RESOLUTION NO. 12:07:11 – 3
RE: Authorizing New Recreation Programming

SUPERVISOR DANIEL J. FRENCH offers the following and moves its adoption:

WHEREAS, the Recreation Department organizes and administrates Recreation Programming in the Town of Beekman; and

WHEREAS, the Recreation Commission has recommended that the Town of Beekman enter into an agreement with USA Sport Group for recreation programming including tennis lessons, basketball clinics, multi-sports, and sports camp; and

WHEREAS, the Town Board is desirous in entering into an agreement with USA Sport Group to further enhance recreational activities and programming; now therefore be it

RESOLVED, that the Town Board hereby authorizes the Supervisor to enter into an agreement with USA Sport Group as attached herewith.

RESOLUTION NO. 12:07:11 – 4
RE: Rescinding Resolution No. 01:13:11 – 6

COUNCILMAN RON MANGERI offers the following and moves its adoption:

WHEREAS, the 2012 Annual Budget does not include funding for the full-time Deputy Clerk position; and

WHEREAS, the Town Board is desirous in terminating this position by rescinding Resolution No. 01:13:11 – 6; now therefore be it

RESOLVED, that the Town Board hereby rescinds Resolution No. 01:13:11 – 6, effective January 1, 2012; and be it further

RESOLVED, that a copy of this resolution be filed with the County of Dutchess Personnel Department.

RESOLUTION NO. 12:07:11 - 6
RE: Authorizing the Rental of Storage Space for Highway and Maintenance Equipment

COUNCILMAN PETER BARTON offers the following and moves its adoption:

WHEREAS, the Town of Beekman storage building located on Pleasant Ridge Road was destroyed last year due to the roof collapsing from the weight of heavy snow and ice; and

WHEREAS, the storage building was used to store Highway and Maintenance equipment; and

WHEREAS, without this building, there is currently no space available to store this equipment; now therefore be it

RESOLVED, that the Town Board hereby authorizes the Supervisor to enter into an agreement with the Estate of Charles Andrews as attached herewith for an amount not to exceed $8400 for a period of 6 months.

RESOLUTION NO. 12:07:11 - 7
RE: Authorizing a Performance Bond for Victoria Estates Section 2 Subdivision

COUNCILMAN PETER BARTON offers the following and moves its adoption:

WHEREAS, Lennar New York, LLC has requested the establishment Performance Bond for the Victoria Estates Section 2 Subdivision; and

WHEREAS, the Town Attorney has reviewed the proposal; and

WHEREAS, the Town of Beekman Planning Board has approved the plans on June 10, 2011 and the plans are available in the Town of Beekman Planning Department; and

WHEREAS, the improvements shall be completed on or before three years from the date of the filing of the approved subdivision plat with the Dutchess County Clerk; now therefore be it

RESOLVED, that the Town Board hereby authorizes the establishment of a Performance Bond for the Victoria Estates subdivision project for the amount of $258,299 as attached herewith.

RESOLUTION 12:07:11 - 8
RE: Authorizing the Comptroller to Purchase a Street Sweeper for the Highway Department

SUPERVISOR DANIEL J. FRENCH offers the following and moves its adoption:


WHEREAS, the Town is looking to purchase a street sweeper to assist the Highway Department in road maintenance and upkeep; and

WHEREAS, the Highway Superintendent has located a used 2004 Elgin street sweeper for the cost of $48,500.00 plus shipping from McAllen Tx. that will fulfill the Town needs; and

WHEREAS, the Town Comptroller has secured lease-to-own financing for this acquisition, the terms of which are outlined in the attached finance document; and

WHEREAS, the Town Board is desirous in obtaining this vehicle as it will enhance service and reduce expenditures and

WHEREAS, the Town Board believes that it is prudent to inspect the vehicle before acquiring it, now therefore be it

RESOLVED, that the Town Board hereby authorizes the Highway Superintendent to travel to McAllen Tx. at the Town’s expense, along with the Deputy Supervisor, who will pay for his on travel expense, for the purpose to inspect the street sweeper and be it further

RESOLVED, that upon completion of the inspection of the vehicle by the Highway Superintendent and the Deputy Supervisor it is confirmed that the street sweeper will fulfill the needs of the Town the Town Board directs the Town Comptroller to proceed to make the necessary arrangements to acquire the street sweeper for a cost not to exceed $48,500.00 plus shipping from McAllen Tx. to the Town.
