RE: Ambulance Contract Supervisor John D. Adams offers the following and moves its adoption:

WHEREAS, the Town Board of the Town of Beekman is authorized pursuant to §122-b of the General Municipal Law to contract for the provision of ambulance services within the Town; and

WHEREAS, the Town Board has received and reviewed a three-year renewal agreement furnished by Alamo Ambulance Service, Inc., our current ambulance service provider; now therefore be it

RESOLVED, that the Supervisor be and hereby is authorized to enter into a three-year contract with Alamo Ambulance Service, Inc. to provide ambulance service for sick or injured persons found within the boundaries of the Town for a term beginning January 1, 2004 and ending on December 31, 2007; and be it further

RESOLVED, that the contract shall be finalized in accordance with Alamo's Agreement received on December 2, 2003 at an annual fee not to exceed $45,000.00 in twelve monthly installments.

RESOLUTION 12:15:03 - 2 RE: To Establish Bond Amount for Grading, Seeding & Haying Councilwoman Barbara Zulauf offers the following and moves its adoption:

WHEREAS, the Town of Beekman Code does not have in place a Bond requirement for grading, seeding, and haying of lawns for new construction in order to prevent erosion of the property or any neighboring property; now therefore be it

RESOLVED, that the Town Board hereby establishes a bond amount of $5,000.00 maximum, and to be determined by the Building Inspector, for new construction for grading and seeding; and be it further

RESOLVED, that this requirement be incorporated into the Town of Beekman's Town Code.

RESOLUTION 12:15:03 - 3 RE: Authorizing Supervisor to Deposit Money In Capital Reserve Funds Councilman Peter Barton offers the following and moves its adoption:

WHEREAS, the Town of Beekman has established by resolution a capital reserve fund for highway garage expansion as well as a capital reserve fund for library site preparation; and

WHEREAS, said resolutions authorizes the Town Supervisor to deposit moneys in the Highway Garage Expansion Fund and the Library Site Preparation Fund; and

WHEREAS, the Town has complied with the provisions required by permissive referendum; now therefore be it

RESOLVED, that the Town Supervisor be and hereby is authorized to deposit moneys in the amount of $82,562.70 for the highway garage expansion and $177,742.18 for the library site preparation, these moneys being presently accounted for within the Town of Beekman General Fund and contained in money market account number 15004203956981 on deposit in M&T Bank; and be it further

RESOLUTION 12:15:03 - 5 RE: Increase in Driveway Permit Fee Councilwoman Barbara Zulauf offers the following and moves its adoption:

WHEREAS, § 65-1 of the Beekman Town Code states that the Highway Superintendent of the Town of Beekman is directed and authorized, upon issuance of a highway permit for any driveway adjoining a Town road of the Town of Beekman, to require from the applicant a deposit to underwrite the completion of proper blacktop apron, appropriate fill and culvert work where necessary; and

WHEREAS § 65-2 states that the amount of said deposit shall be set by the Highway Superintendent according to the extent of the improvements; and

WHEREAS, the current fee of $750.00 for a driveway apron permit has not been raised since 1991; and

WHEREAS, the price of black top has more than doubled since above date; and

WHEREAS, the Highway Superintendent estimates the cost of installing a driveway apron at $900.00 and requests the Town Board to increase the minimum fee accordingly; now therefore be it

RESOLVED, that a deposit of $900.00 be and is hereby set for a routine 15 foot apron without culvert; and be it further

RESOLVED, that the Town Code be modified to indicate the increase in fee.

RESOLUTION 12:15:03 - 6 RE: Establishing Capital Reserve Fund for Restoration of Town Buildings Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, a provision had been made in the Town of Beekman 2003 Budget for building renovations; and

WHEREAS, all projects for this expenditure have not yet been completed; now therefore be it

RESOLVED, that pursuant to Section 6-c of the General Municipal Law, as amended, the Town Board of the Town of Beekman does hereby establish a Capital Reserve Fund to finance the renovations of town buildings; and be it further

RESOLVED, that the Town Supervisor be and hereby is directed to deposit monies of this Reserve Fund in a bank account, intermingled with other town funds, to be known as the "Building Restoration Capital Reserve Fund"; and be it further

RESOLVED, that the Town Supervisor be and hereby is authorized to invest, from time to time, the monies of this fund pursuant to Section 11 of the General Municipal Law and the Town's investment policy.

RESOLVED, that no expenditures shall be made from the fund except upon authorization of the Town Board; and be it further

RESOLVED, that this resolution is subject to permissive referendum pursuant to statute made and provided.

RESOLUTION 12:15:03 - 8 RE: Adopting Tax Payment Extension of the Patriot Plan Councilwoman Barbara Zulauf offers the following and moves its adoption:

WHEREAS, the State Legislature has enacted Chapter 106, Laws of 2003, also known as the Patriot Plan providing a variety of benefits and privileges to military personnel on active duty and their families; and

WHEREAS, Section 925-D of said act provides for the extension of time for the payment of real estate taxes without penalty for up to ninety days following the end of active military personnel's deployment; and

WHEREAS, the Town Board of the Town of Beekman is desirous of demonstrating its support of any Town residents who are, or may be, called to active duty; and

WHEREAS, the Receiver of Taxes of the Town has voiced her support for this proposal; and

WHEREAS, in order to confer the benefits of this provision it is necessary for the Town Board to adopt a formal resolution; now therefore be it

RESOLVED, that the Town of Beekman hereby adopts the provisions of Section 925-D of the act know as the Patriot Plan and authorizes the Receiver of Taxes to extend the privileges afforded under such act to those service men and women and their families who may qualify thereunder.

RESOLUTION 12:15:03 - 9 RE: Authorizing Participation in Request for Proposal Specifications - Dutchess County Reassessment Consortium Councilman Peter Barton offers the following and moves its adoption:

WHEREAS, the Town of Beekman is considering a reassessment of all real property to achieve equitable assessments of each parcel located in the Town; and

WHEREAS, the last town-wide reassessment was conducted in 1990; and

WHEREAS, entering into a cooperative effort with other municipalities to undertake a municipal-wide reassessment project using the same contractor would save the town money; and

WHEREAS, the Dutchess County Reassessment Consortium (DCRC) was formed for such purpose; now therefore be it

RESOLVED, that the Town Board of the Town of Beekman authorizes its willingness to participate with other municipalities in requesting proposals from companies interested in providing contractual services necessary to conduct a tax reassessment according to the specifications outlined by the Dutchess County Reassessment Consortium.

RESOLUTION 12:15:03 - 11 RE: Accepting Roosevelt Drive as a Town Highway Supervisor John D. Adams offers the following and moves its adoption:

WHEREAS, the Dalton Farms subdivision calls for the construction of certain roads including one known as Roosevelt Drive together with a number of drainage easements; and

WHEREAS, both the easement areas and the highway known as Roosevelt Drive itself have now been completed to the satisfaction of the Town Engineer and Town Highway Superintendent and according to the specifications of the Town of Beekman as certified by the developer's engineer, Robert J. Gray, P.E.; and

WHEREAS, the Town Engineer has recommended that the existing performance bond or undertaking be retained for a period of one year from acceptance and appropriate maintenance bond against failure or defect in said highway and appurtenant improvements; and

WHEREAS, the Attorney to the Town has received and reviewed the documents necessary to convey title to said highway and improvements to the Town and has approved the same for recording in the Dutchess County Clerk's Office; and

WHEREAS, it appears to be in the best interests of the Town and a fulfillment of said development as specifically intended by the Planning Board that Roosevelt Drive should become a town highway; now therefore be it

RESOLVED, that the Town Board of the Town of Beekman hereby accepts the said Roosevelt Road and its appurtenant easements as a Town Highway and undertakes the maintenance thereof effective December 19, 2003; and be it further

RESOLVED, that the Town of Beekman Highway Superintendent be requested to add Roosevelt Drive to his inventory of Beekman town highways.
