RE: Amending the Name of the Alternate Delegate Association of Towns Councilwoman Barbara Zulauf offers the following and moves its adoption:

WHEREAS, the Deputy Supervisor was named at the Re-organization Meeting as the alternate delegate at the 2004 Association of Towns Meeting; and

WHEREAS, the Deputy Supervisor is unable to attend the meeting; now therefore be it

RESOLVED, that Councilman Thomas Kinsley be designated as the alternate delegate to the Town.

RESOLUTION 1:26:04 - 2 RE: To Reduce Bond for Angela Estates Councilman Thomas Kinsley offers the following and moves its adoption:

WHEREAS, the Town Board is authorized to approve reductions in subdivision performance bonds pursuant to §277-9(d) of the Town Law; and

WHEREAS, Angela Estates has completed a majority of the bonded work and is requesting a Performance Bond Reduction; and

WHEREAS, the Town Engineer has inspected the site and has determined that the works for which a reduction has been applied for have been completed in compliance with the approved plans and specifications; and

WHEREAS, at the December 18, 2003 Planning Board Meeting, the Bond Reduction was approved; and

WHEREAS the Planning Board recommends that the Town Board approve a reduction in the Performance Bond to $32,222.00; now therefore be it

RESOLVED, that the Town Board approves the reduction in Performance Bond to $32,222.00 for Angela Estates and authorizes the applicant to substitute the current bond on file in the office of the Town Clerk with the new Performance Bond in the amount of $32,222.00.

RESOLUTION 1:26:04 - 3 RE: Authorizing 2004 Dial A Ride Contract Renewals Supervisor John Adams offers the following and moves its adoption:

WHEREAS, the Town of Beekman participates in the Dial A Ride Transportation System for senior citizens; and

WHEREAS, the 2004 budget provides for the cost of this program not to exceed $9,498.24; now therefore be it

RESOLVED, that the Supervisor be and hereby is authorized to sign the 2004 Dial A Ride Contract Renewals.

RESOLUTION 1:26:04 - 4 RE: Suspending Assessments and Actions of Ethics Board Pending Establishment of Rules of Procedure Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, §19-8(F) of the Beekman Town Code requires the Board of Ethics to adopt rules and regulations to govern its procedure, subject to the approval of the Town Board; and

WHEREAS, to date said rules and regulations have not yet been adopted; now therefore be it

RESOLVED, that until said time of adoption of rules and regulations, any assessments or actions by the Board of Ethics and review of disclosure statements by the Board of Ethics is hereby suspended.

RESOLUTION 1:26:04 - 5 RE: Accepting Deed to Flagler Road for Dedication Supervisor John Adams offers the following and moves its adoption:

WHEREAS, a portion of the highway known as Flagler Road on the subdivision map known as Orr Estates, Section 1-A has been completed to the Town of Beekman road specifications; and

WHEREAS, the Town Engineer and Town Highway Superintendent have recommended the acceptance of said portion of Flagler Road; and

WHEREAS, the Attorney to the Town has reviewed the title and conveyance documents tendered by the developer to accomplish the transfer of this portion of the road and has approved the same; and

WHEREAS, the Planning board has recommended a reduction of the present performance bond to the amount of $30,000 to be retained as a maintenance bond against the need for repairs and replacement of said road within two years of acceptance; and

WHEREAS, it is in the best interests of the Town and its residents that said road portion be accepted as a town highway; now therefore be it

RESOLVED, that portion of Flagler Road described in the conveyancing documents provided to the Attorney to the Town be accepted as a Town Highway and the Highway Superintendent be instructed to add said road portion to the inventory of Town of Beekman Highways.

RESOLUTION 1:26:04 - 6 RE: Authorizing Stipend for Deputy Town Clerk at Green Haven Correction Facility Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, Mr. Patrick King is appointed as Deputy Town Clerk for the "Issuance of Marriage Licenses only" at the Green Haven Correctional Facility; and

WHEREAS, this appointment eliminates the need for the Town Clerk of the Town Beekman to travel to the prison to issue marriage licenses; and

WHEREAS, on an average, ten licenses are issued per month consisting of a lengthy and complex process; and

WHEREAS, the Town Clerk of the Town of Beekman, Virginia Ward, has recommended that Mr. King receive a stipend in recompense for the excellent job he does in preparing and presenting these documents; now therefore be it

RESOLVED, that a stipend is set for Patrick King in the amount of $500.00 to be payable in one lump sum in December of each year.

RESOLUTION 1:26:04 - 7 RE: To Set Public Hearing for Local Law #2 of 2004 Naming of Records Management Office Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, the Town has been awarded a Records Management Improvement Fund grant and will be seeking additional Records Management Improvement grant funds; and

WHEREAS, in conjunction with present and future grants it is necessary to establish a Records Management Program in the Town of Beekman as well as name a Records Management Officer; now therefore be it

RESOLVED, that a Public Hearing on a proposed Local Law providing for the creation of a Records Management Program in the Town of Beekman shall be held on the 1st day of March, 2004 at 7:00 p.m. at the Town Hall, 4 Main Street, Poughquag, New York; and be it further

RESOLUTION 1:26:04 - 8 RE: To Schedule Public Hearing Poughquag Hamlet Water Improvement Area Councilwoman Barbara Zulauf offers the following and moves its adoption:

WHEREAS, the Poughquag Hamlet Water Improvement Area District is currently charged a monthly service and maintenance fee by the Town who maintains and operates the water improvement area; and

WHEREAS, Dutchess County Water and Wastewater Authority has shown an interest in servicing the Poughquag Hamlet area properties as part of their acquisition of the Farms Water System; now therefore be it

RESOLVED, that a Public Hearing on the options available for operation and maintenance of the Poughquag Hamlet Water Improvement Area shall be held on the 23rd day of February, 2004 at 7:05 p.m. at the Town Hall, 4 Main Street, Poughquag, New York; and be it further

RESOLUTION 1:26:04 - 10 RE: Authorizing Agreement Between the Dutchess County Sheriff's Department and the Town of Beekman Councilman Werner Stiegler offers the following and moves its adoption:

WHEREAS, the Town has requested that the County of Dutchess authorize the Sheriff of Dutchess County to provide police protection over and above the police protection budgeted and allocated for the Town, including security services at Town Court; now therefore be it

RESOLVED, that the Supervisor be and hereby is authorized to sign an agreement between the County with the Town of Beekman for additional Sheriff's Police Services as outlined in the attached agreement.

RESOLUTION 1:26:04 - 11 RE: To Schedule a Public Hearing - Local Law #1 - Snow Ordinance for Parking Councilman Thomas Kinsley offers the following and moves its adoption:

WHEREAS, the parking of vehicles on the streets and highways of the Town of Beekman during snow storms make it difficult to remove snow by the Town Highway Department as well as cause hazardous conditions for other drivers; now therefore be it

RESOLVED, that a Public Hearing on proposed Local Law prohibiting parking on the streets and highways of the Town whenever snow has fallen shall be held on the 23rd day of February, 2004 at 7:00 p.m. at the Town Hall, 4 Main Street, Poughquag, New York; and be it further

RESOLUTION 1:26:04 - 12 RE: Transfer of Funds to "Highway Equipment Capital Reserve Fund" Supervisor John Adams offers the following and moves its adoption:

WHEREAS, a Highway Equipment Capital Reserve Fund was established for the purpose of financing the cost of the procurement and replacement of the Town Highway Department's fleet of heavy equipment; and

WHEREAS, at the end of fiscal 2003, the Highway Fund has unspent money in its Machinery EQ appropriation (51304DA) of $21,849.75 due to the fact that only one of two trucks planned as an addition to the fleet in 2003 was purchased; now therefore be it

RESOLVED, that the $21,849.75 unspent funds be added to the "Highway Equipment Capital Reserve Fund"; and be it further

RESOLVED, that any expenditure from this reserve fund be and hereby is subject to permissive referendum under the terms of the establishment of said reserve fund.
