Board Appointments

Councilman Thomas Kinsley offers the following and moves its adoption:

WHEREAS, the Town Board will make appointments to the various boards; and

WHEREAS, the Office of Real Property Services is requesting the timely reporting of Board of Assessment Review (BAR) member appointments and reappointments; and

WHEREAS, the terms of office prescribed by Section 523 of the Real Property Tax Law must begin on October 1 and end on September 30, five years later; and

WHEREAS, the Town Board is desirous in filling an expired term and complying with the request by the Office of Real Property Services; now therefore be it

RESOLVED, that the Town Board hereby makes the following reappointment to be effective immediately:

Board of Assessment Review Walter Klein Term to expire 9/30/14

And be it further RESOLVED, that this appointment is contingent upon the filing of his Oath of Office with the Town Clerk and the completion and submission of the new Disclosure of Interest Statement pursuant to Chapter 19, Section 19-9 of the Town Code unless already on file and information has not changed.

RESOLUTION 12:21:09 - 2 Pursuant to Highway Law Sec. 212-a Abandoning a Portion of Cedar Lane, A Town Road

Supervisor John Adams offers the following and moves its adoption:

WHEREAS, New York State Highway Law Sec. 212-a authorizes a Town Board to release to an adjoining owner a portion of a road which through further extension or improvement is of no further use for highway purposes; and

WHEREAS, there exists an unimproved cul-de-sac on the west side of Cedar Lane which, due to the extension of Cedar Lane and the location of another cul-de-sac, is of no further use for highway purposes; and

WHEREAS, the owner of the adjoining Lot #8 of Filed map #3069 known as The Cedars Subdivision has requested that said area be released to him has provided the within metes and bounds description thereof (“Exhibit A”) to be prepared by Robert V. Oswald, Jr., Land Surveyor; and

WHEREAS, said release is recommended by the Town Highway Superintendent and consented to by the Dutchess County Superintendent of Highways as required by the statute provided;

NOW THEREFORE BE IT RESOLVED,
  1. That the unimproved portion of the said cul-de-sac on the west side of Cedar Lane be released to the adjoining owner, William J. Beyer or his assign, and that the Town Supervisor be authorized to execute a quitclaim deed and attendant documents conveying the same; and
  2. That said portion of said cul-de-sac be deemed abandoned.

RESOLUTION 12:21:09 - 3 Authorizing Increase of User Rates for the Dover Ridge Water and Sewer District

Councilman Daniel French offers the following and moves its adoption:

WHEREAS, the Town Board of the Town of Beekman is responsible for the operation and management of the Dover Ridge Water and Sewer District; and

WHEREAS, a public hearing was duly held on December 7, 2009 on adjusting the water and sewer rates to reflect the actual costs of operating the water and sewer districts; now therefore be it

RESOLVED, that effective January 1, 2010, quarterly invoices sent to all homeowners of the Dover Ridge Estates for water usage and sewer service will reflect the following rates:

Water Usage: $184.11
Sewer Service: $288.42

RESOLUTION 12:21:09 - 4 Authorizing SRF Funds for Ice Skating Rink

Councilwoman Barbara Zulauf offers the following and moves its adoption:

WHEREAS, the mission of the Town of Beekman Recreation and Parks Department is to provide recreational opportunities which will encourage a healthy and active lifestyle; and

WHEREAS, a portable ice skating rink installed at Recreation Park would provide a healthy winter activity for the residents of Beekman to enjoy; and

WHEREAS, the Recreation Commission along with the Recreation Director have researched the feasibility of purchasing a portable ice skating rink and have recommended the “Nice Rink, which meets all the safety and construction criteria suitable for the Town of Beekman’s needs; now therefore be it

RESOLVED, that the Town Board hereby authorizes the use of Special Recreation Funds (SRF) for the purchase of a portable ice skating rink at a cost not to exceed $12,000.00.

RESOLUTION 12:21:09 - 5 Authorizing the Supervisor to Sign the Contract With Dutchess County Soil & Water Conservation District For the Construction of the Green Infrastructure Stormwater Retrofit of the Town Hall Parking Lot

Councilman Daniel French offers the following and moves its adoption:

WHEREAS, in order to address the stormwater runoff from the Town Hall parking lot, the Dutchess County Soil & Water Conservation District (“The District”) will be managing a grant for the Town to construct the Green Infrastructure Stormwater Retrofit of the parking lot at Town Hall on 4 Main Street in the Town of Beekman, Dutchess County, New York; now therefore be it

RESOLVED, that the Supervisor is hereby authorized to sign the contract with the District for the construction of the Green Infrastructure Stormwater Retrofit of the parking lot.
